WMC Mortgage Corporation, (ItcreinaRcr referred to as "Plaintiff") is an Institution, conducting business under the Laws of the Commonwealth of Pennsylvania and brings this action to foreclosure the mortgage between Charles W. & Judith L. Johnson, Mortgagor(s) (hereinafter referred to as "Defendant") and itself as Mortgagee. Said Mortgage was dated July 30, 1998 and was recorded in the Office of the Recorder of Deeds and Mortgages in Cumberland County in Mortgage Book 1472, page 747. A copy of the Mortgage is attached and made a part hereof as Exhibit'A'. 2. The Mortgage is secured by Defendant(s) Note dated July 30, 1998 in the amount of $39,900.00 payable to Plaintiff in monthly installments with an interest rate of 10.75%. 3. The land subject to the mortgage is: 232 Mulberry Avenue, Carlisle, PA 17013. 4. The defendant(s), Charles W. & Judith L. Johnson are the real owner(s) of the land subject to the mortgage and the Defendants' address is : 232 Mulberry Avenue, Carlisle, PA 17013. 5. The Mortgage is now in default due to the failure of the Defendant(s) to make payments as they become due and owing. The following amounts are due: Principal Balance: $39.854.53 Interest to 9/6/99 $ 3,270.40 Accum. Late charges $ 181.20 Attorney Fcc/costs $ 3,700.00 TOTAL: $47,006.13 plus interest from 9/7/99 at $11.68 per day, costs of suit and attorney fees. 6. In accordance with the provisions of the Act of January 30, 1974, P.L. 13 No. 6, Section 403 (41 P.S. 403), a Notice of Intention to Foreclose is required and was sent January 5, 1999. A Notice of Homeowners' Emergency Mortgage Assistance was sent to defendants January 5, 1999. The Defendant(s) have not cured the default. WHEREFORE, Plaintiff requests the court enter judgment in Mortgage Foreclosure for the sale of the mortgaged property in Plaintiffs favor and against the Defendant(s), in the sum of $47,006.13 together with the interest from 9/7/99 at $11.68 per day, costs of suit and attorney fees.
