Defendants : IN THE COURT OF COMMON PLEAS : CUMBERLAND COUNTY, PENNSYLVANIA : : CIVIL ACTION - LAW COMPLAINT The Plaintiff, James Harper, is an adult individual residing at 26 Buttonwood Lane, Carlsile, Pennsylvania 17013. The Defendant, Wendell Priest, is an adult individual with an address of P.O. Box 285, Floresville, Texas 78114. The Defendant, Bullseye Express Inc., is a corporation doing business at 5 Willow Springs Circle, York, PA 17402. The facts and occurrences hereinafter related to took place on or about February 26, 2003 on Interstate 81 northbound near mile marker 58.5 in Mechanicsburg. At the time and place aforesaid, Plaintiff was the owner and operator of a 2001 Chevrolet Tracker which was then and there traveling in the right hand lane of 181 heading north. At the time and place aforesaid, Defendant Wendell Priest, was operating a tractor trailer owned by Defendant, Bullseye Express, Inc., and was in the course of his employment. As Plaintiff was traveling north in the dght hand lane of 181 he was struck from behind by Defendant Pdest, causing the damages hereinafter set forth. 8. The aforesaid accident and damages resulting therefrom were caused by the negligence of Defendant Priest in that he: (a) Failed to keep a proper lookout for other vehicles (b) Failed to have his vehicle under control (c) Operated his vehicle at a speed too fast for conditions then and there existing (d) Failed to keep a proper separation of his vehicle from Plaintiff's vehicle. 9. Solely as a result of the Defendant's negligence, Plaintiff sustained total damages in the amount of $6,766.82 for repair of its vehicle as well as rental of another vehicle while repairs were being made.
