WAIVER OF IA ENS
WHEREAS, Russell A. Ludlow and Diane H. Ludlow, of Cumberland County, Pennsylvania, entered into a
contract with Haubcrt Homes, of Cumberland County, Pennsylvania, to provide materials and perfomi labor
necessary for completion or a residential dwelling situate upon lot of ground located:
Indian Peg Road Lot 4, Boiling Springs, PA 17007, Monroe Township, Cumberland County,
PENNSYLVANIA, as more particularly set forth in Exhibit "A" attached hereto.
NOW, THEREFORE, it is hereby stipulated and agreed by and between the said parties, as part of the said
contract and for the consideration therein set forth, that neither the undersigned contractor, any sub-contractor or
material man, nor any other person furnishing labor or materials to the said contractor under this contract shall
file a lien for work done or materials furnished to the said building or any part thereof.
This stipulation is made and intended to be filed with the County Prothonotary within ten (1) days after date, in
accordance with the requirements of the Act of Assembly of Pennsylvania, in such case provided.

ALL THAT CERTAIN piece or parcel of land situate in Monroe Township, Cumberland County, Pennsylvania,
described in accordance with a survey and plan thereof prepared by Ilartman and Associates, inc., dated October 18,
1990, which premises are bounded and described as follows, to wit:
BEGINNING at a point at the intersection of lands of William Anderson and George Anderson and Charles K.
Myers at the northwest comer of the premises hereinafter described; thence along lands now or late of Charles K.
Myers North sixty-nine (69) degrees thirty (30) minutes East one hundred sixty-nine and ninety-five hundredths
(169.95) feet to a point at line of lands now or late of Clair Raker; thence along same South twenty-one (21) degrees
thirty (30) minutes East and crossing Indian Peg Road one thousand three hundred eighty-six and fifteen hundredths
(1,386.15) feet to a point at line of lands now or late of the Dog house Hunting Club; thence along same South
sixty-nine (69) degrees twelve (12) minutes West one hundred sixty-nine and ninety-four-hundredths (169.94) feet
to a point at line of lands of William Anderson and George Anderson; thence along same North twenty-one (21)
degrees thirty (30) minutes West one thousand three hundred eighty-seven and four-hundredths (1,387.04) feel to
the point and place of BEGINNING.
CONTAINING 5.4090 acres of land.
BEING THE SAME PREMISES which Charles M. Fogarty and Jennifer A. Fogarty, his wife, by Deed hearing date
the 81h day of May, 1992, and recorded in the Office of the Recorder of Deeds in and for Cumberland County,
Pennsylvania, on the 13th of May, 1992, in Dced Book 35-Q, Page 1100, granted and conveyed unto Russell A.
Ludlow and Diane H. Ludlow, his wife.
