COMPLAINT IN CONFESSION OF TUDGMFNT
Plaintiff, Atlantic National Trust, LLC, by and through its attorneys, Klehr, Harrison,
Harvey, Bmuzburg& Ellers, by way ofcomplaint in confession ofjudg ucat avers and representsas follows:
Plaintiff, Atlantic National Trust, LLC ("Atlantic" or the "Plaintiff'), isa limited
liability corporation with an office at 50 Portland Pier, 41h Floor, Portland, ME 04101.
2. Defeadatn, Donald L. Kitaer("Defendant") isanadult individual and citizen ofthe
Commonwealth of Pennsylvania who resides at 100 2nd Street, New Cumberland, PA 17070-
3. On or about May 16, 1994, Meridian Bank ("Maid ian") agreed to loan Defendant
and Defendant agreed to borrow the principal sum of $60,000.00 (the "Loan'). 'file Loan is evidenced by
that certain promissory note dated May 16. 1994 (the "Note") executed and delivered to Nicridimt by
Defendant. A true and correct copy of the Note: is attached hereto, marked as Exhibit "A" tmd incorporated
herein by reference.
4. Meridian subsequently merged with Corestates 13ank, N.A. which subsequently
merged will, First Union National Bank.

5. Oil or about April 28, 1999 First Union National Bank assigned all right, title and
interest in the Note to Atlantic pursuant to an Assignment of Loan Agreement. As such, Atlantic is holder
of the Note. A true and correct copy of the Assignment of Loan Agreement is attached hereto and
incorporated herein as Exhibit "13".
6. The Note contains a warrant of attorney which authorizes tine entry of judgment by
confession against Defendant in favor of Meridian, its successors and assigns.
7. On May 15, 1999, the Note matured causing all sums clue thereunder to become
inured iately due and payable.
8. As of October 21, 1999, Defendant was in Default of his obligations pursuant to the
terms of the Note as a result of, inter alia., his failure to pay all stuns due under the Note upon maturity (the
"Default").
9 As a result of the aforennentioned Default, file following amounts are immediately
due and payable from the Defendant in accordance with the terns of the Note:

$12,000.00
Interest(throu.-b 10/21/99) 2.235.79
TOTAL 14.235.79
Interest continues to accrue from and after October 21, 1999 at $3.00 per client. Additionally, Atlantic
reserves the right to collect reasonable attorney's fees it has incurred and will incur in this matter pursuant
to the Note.
10. This judgment is not being entered by confession against a natural person in
connection with a consumer credit transaction.
II. Judgment has not bcencritered against Defendant pursuant to the warrant of attorney
contained in the Note in this or any other jurisdiction.
12. An Affidavit of Default is attached hereto.

WHEREFORE, plaintiff, Atlantic National Trust, LLC, demands judgment in its favorand
against defendant, Donald L. Kitner in the amount of $14,235.79, together with interest from and after
October 21, 1999 at the per client rate of $3.00, reasonable attorney's fees and costs ol'suit as they accrue.

NATIONAL BANK ("Seller') for good and valuable consideration, in favor of ATLANTIC
NATIONAL TRUST, LLC ("Purchaser') pursuant to a certain Asset Sale Agreement between,
inter alia, Seller and Purchaser, dated April 20, 1999, which is hereby incorporated by reference
("Ae*eemenP'). All capitalized terms used but not defined herein are defined in the Ageement.
Seller hereby assigns, transfers and sets over to Purchaser, its successors and assigns,

WELATSOEVER, WHETHER EXPRESSED OR EYIPLIED, except and only to the extent
otherwise provided in the Agreement, all Sellers right, title and interest in and to the Promissory
