COMPLAINT IN CONFESSION OF.IUDGMGNT
Plaintiff, Atlantic National Trust, LLC, by and through its attorneys, Klehr, Harrison,
Harvey, Branzburg& Ellers, by way ofcomplaint in confession ofjudgment avers and represents as follows:
Plaintiff, Atlantic National Trust, LLC ("Atlantic" or the "Plaintiff'), is a limited
liability corporation with an office at 50 Portland Pier, 4th Floor, Portland, ME 04101.
2. Defendant, Donald L.Kitner("Defendant')istnadultindividualandcitizen orthe
Commonwealth of Pennsylvania who resides at 100 2nd Street, New Cumberland, PA 17070.
3. On or about Febrtmry 27, 1995, Meridian Bank ("Meridian') agreed to loan
Defendant and Defendant agreed to borrow the principal sum of $25,000.00 (the "Loan'). The Loan is
evidenced by that certain promissory note dated February 27, 1995 (the "Note") executed and delivered to
Meridian by Defendant. A true and correct copy of the Note is attached hereto, marked as Exhibit "A" and
incorporated herein by reference.
4. Meridian subsequently merged with Corestates Bank, N.A. which subsequently
merged with First Union National Bank.

5. On or about April 28, 1999 First Union National Dank assigned all right, title and
interest in the Note to Atlantic pursuant to an Assignment of Loan Agreement. As such, Atlantic is holder
of the Note. A true and correct copy of the Assignment of Loan Agreement is attached hereto and
incorporated herein as Exhibit "D".
6. The Note contains a warrant of attorney which authorizes the entry o1 judgment by
confession against Defendant in favor of Meridian, its successors and assigns.
7. As of July 27, 1999, Defendant was in default of his obligations pursuant to the
terms of the Note as a result of, inter alia., his failure to pay sums due under the Note (the "Default").
8. As a result of the Default, Plaintiff made demand for payment of all sums due and
owing under the Note pursuant to a letter sent by counsel for Plaintiff to Defendant on October 4, 1999 (the
"Demand Letter"). A true and correct copy of the Demand Letter is attached hereto and incorporated as
Exhibit "C".
9. As a result ofthe aforementioned Default, the following amounts are immediately
due and payable from the Defendant in accordance with the terns of the Note:

Interest (through 10/21/99) 3.950.16
TOTAL 27 663.97
Interest continues to accrue from and after October 21, 1999 at $6.26 per diem. Plaintiff reserves the right
to collect reasonable attorney's fees it has incurred and will incur in this matter as authorized by the Note.
10. This judgment is not being entered by confession against a natural person in
connection with a consumer credit transaction.
H. Judgment hasnot been enteredagainst Defendant pursuant to thewarrantof attorney
contained in the Note in this or any other jurisdiction.
12. An Affidavit of Default is attached hereto.

WHEREFORE, plaintiff, Allantic National Trust, LLC, demands judgment in its favor and
against defendant, Donald L. Kitner in the amount of $27,663.97, together with interest from and after
October 21, 1999 at the per diem rate of $6.26, reasonable attorney's Ices and costs of suit as they accrue.

Pursuant to the loan documents, you have assigned to the lender a certain life insurance
policy number 40226543 issued by Equitable Life Assurance Society of the United States. This life
insurance policy has a cash surrender value. The lender hereby demand that you notify the life
insurance company to redeem that policy and remit the cash surrender value to the lender.
In addition to the life insurance policy, various items of tangible and intangible personal
property have been pledged to the bank as collateral including accounts receivable, inventory,
equipment and other personal property used or useable in the landscaping business. The lender
demands a turnover of all such collateral if the loans are not satisfied by October 11, 1999.
