STIPULATION AGAINST LIENS
THIS AGREEMENT made the 1I2;i? of q 1999, by and
between McNAUGHTON HOMES, INC.,
AND
MICHAEL F. JONES and GAIL, P. JONES, hereinafter referred to as
owner, whereby the former undertook and agreed to erect and
construct a single family dwelling on that certain lot of ground
situate in
LOT 4, YORK ROAD, LIBERTY ESTATES, PLAN BOOK 67, PAGE 122, SOUTH
MIDDLETON TOWNSHIP, CUMBERLAND COUNTY
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for and in consideration of the sum of ($1.00) Dollar
to in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for themselves and their subcontractors, and
all parties acting through or under them, covenant and agree that
no mechanic's liens or claims shall be filed or, maintained by
them or any of them against the said buildings and the lot of
ground appurtenant thereto for or on account of any work done or
materials furnished by them or any of them under said contract or
otherwise, for, towards, in, or about the erection and
construction of the said buildings on the lot above described,
and the said Contractor, for themselvee, their subcontractors and
others under them hereby expressly waive and relinquish the right
to have, file, and maintain any mechanic's liens or claims
against the said buildings or any of them, and agree that thie
instrument, waiving the right of lien, shall be an independent
covenant.

ALL THAT CERTAIN tract of land situate in the Township of
South Middleton, County of Cumberland, and Commonwealth of
Pennsylvania, being more particularly bounded and described as
follows, to wit: :
BEGINNING at a point in the centerline of York Road (S.R. 74),
said point marking the common point of adjoiner of the within
described tract, Lot #3, and the center of said roadway; thence
departing from the centerline of York Road, and extending along
Lot #3, North thirty-one (31) degrees forty-nine (49) minutes
fifty-two (52) seconds East, through a steel pin set on the
northeasternmost dedicated right-of-way line of York Road, a
distance of thirty and no hundredths (30.00) feet from the origin
of this call, for a distance of four hundred thirty and no
hundredths (430.00) feet to a steel pin at Lot #11; thence
extending along Lots #11 and #8 on the hereinafter mentioned
plan, South fifty-eight (58) degrees ten (10) minutes eight (8)
seconds East, for a distance of two hundred fifty and no
hundredths (250.0 O) feet to a steel pin at Lot #5; thence
extending along Lot #5, South thirty-one (31) degrees forty-nine
(49) minutes fifty-two (52) seconds West, through a steel pin set
on the northeasternmost dedicated right-of-way line of York Road,
a distance of thirty and no hundredths (30.00) feet from the
terminus of this call, for a total distance of four hundred
thirty and no hundredths (430.00) feet to a point in the
centerline of Yor}c Road; thence extending in and through the
centerline of Yor}c Road, North fifty-eight (58) degrees ten (10)
minutes eight (8) seconds West, for a distance of two hundred
fifty and no hundredths (250.00) feet to a point in the center of
said roadway at Lot #3, said point marking the place of BEGINNING.
CONTAINING 2.2960 acres to the dedicated right-of-way, and
2-4679 acres to t1ae centerline of York Road, and being designated
as Lot #4 on the final plan of subdivision of Liberty Estates
prepared by Stanl ay Jarmolenko, Registered Surveyor, dated
October 27, 1992, and recorded in the Office of the Recorder of
Deeds in and for Cumberland County, Pennsylvania in Plan Book 67,
at page 128.
