WHEREAS, Pennsylvania-American Water Company, Owner herein, of Hershey,
Pennsylvania, is about to execute contemporaneously herewith, a Contract, with
Commonwealth Disp. , Contractor herein, of Harrisburg, PA. , for
the Removal, Transportation and Disposal of Water Purification Plant Residue from
Pennsylvania-American Water Company - Silver Spring Water Treatment Plant located in
Cumberland county.
NOW, October 21, 11999, at the time of and immediately before the execution
of the principal Contract, and before any authority has been given by the said Owner to the
said Contractor to commence work on the Removal, Transportation and Disposal of Water
Purification Plant Residue from the Pennsylvania-American Water Company Silver Spring
Facility or purchase materials for the same in consideration of the making of the said Contra.-.a
with Owner and the further consideration of One Dollar (S 1.00) to Contractor paid by Owner, it
is agreed that no lien shall be filed against any Pennsylvania-American Water Company
owned facility where water purification plant residue shall be removed, transported and disposed
of by the Contractor, or any subcontractor, nor by any of the material men or workmen or any
other person for any labor, materials purchased or extra labor or materials purchased for the
Removal, Transportation and Disposal of Water Purification Plant Residue from
Pennsylvania-American Water Company and the right to file such liens being expressly
waived.
