hereinafter referred to as Contractor,
AND
JAMES B. VAN KIRK and PAMELA F. VAN KIRK, husband and wife,
, hereinafter referred to as
Owner, whereby thefortnerundertookand agreed to erect and constructs dwelling house
on that certain lot ofgroaod situate in
in the Borough of Mechanicsburg, Cumberland County, Pennsylvania, more fully
described in a certain deed from Sechrist Development Corp. to Owners abovenamed
dated September 30, 1999, and recorded on October 1, 1999, in the Office of the
Recorder of Deeds in and for Cumberland County, Pennsylvania, in Deed Book 208,
Page 901, said description relates to Lot fit on a certain "Preliminary/Final
Subdivision Plan for Sechrist Development Corp. as recorded in said Recorder's
Uffice in Plan Book 79, Page 87, said description being incorporated herein by
reference thereto.
NOW T HF.RFFORE. 7711S AGREE,IIEA'7' IF17':VFSSb'771. That the said Contractor, for and in consideration of
the sure of ($1.00) Dollar to it in hand paid by Owner, the receipt whereof is hereby
acknowledged, find the further consideration mentioned in the agreement aforesaid, for themselves and their
subconrrartors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims
shall be filed or maintained by them or any of there against the said buildings and the lot of ground appurtenant
thereto for or an account of any work done or rnaterinLs fitrnished by diem or tiny of therm under said contract or
otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described,
arid the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and
relinquish the right to hare, file, and maintain any mechanic's liens or claims against the said buildings or any of
then, and agree that this instrument, t airing the right of lien. shall be an independent covenant.
