HomeMy WebLinkAbout99-06763,)i„ )i vt-J/0/_fJ Ts- Stipulation Against Liens THIS AGEEMENT made this day of November, 1999 by and between: Wagman Construction, Inc. 3290 Susquehanna Trail North York, Pennsylvania 17402 hereinafter referred to as Contractor, AND 6380 Brackbill Associates P.O. Box 1549 Mechanicsburg, Pennsylvania 17055 Owner, whereby the former undertook and agreed to construct a new 16,000 +- square foot building consisting of office and warehouse space to be located on that certain tract of land located on the comer of Brackbill Road and Silver Springs Road, (adjacent to the existing Carlisle Carrier building) in Hampden Township, Cumberland County Pennsylvania, more fully described in Exhibit "A", attached hereto and incorporated by reference. NOW THEREFORE THIS AGREEMENT WITNESSETH: That the said Contractor, for an in consideration of the sum of ($1.00) Dollar to it in hand paid by the owner, the receipt whereof is hereby acknowledged and the further consideration mentioned in the agreement aforesaid, for themselves and their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. Co.nly, PA My Commission EI VI(Cf Feb, 5, 2001 Signed, Sealed and Delivered ALL THAT CERTAIN tract of land situate in ftampden Township, Cumberland County, Pennsylvania, more particularly bounded and described in accordance with the Final Subdivision Plan of a tract of land for Cumberland-Perry Association for Retarded Citizens, prepared by D.P. Raffensperger Associates, Camp Hill, Pennsylvania, dated June 8, 1979, and recorded in the office of the Recorder of Deeds of Cumberland County, Pennsylvania, on September 17, 1979, in Plan Book 36, Page 67, as follows, to wit: BEGINNING at a point at the northeast corner of land now or formerly of Cumberland-Perry Association for Retarded Citizens at the property now or formerly of Christopher Garman and now or formerly of Raymond Brackbill; thence South 41 degrees 45 minutes East 525.38 feet to a point at the northern right of way line of Brackbill Boulevard; thence along said right of way line South 48 degrees 16 minutes 20 seconds West 774.71 feet to a point; thence along other lands now or formerly of Cumberland-Perry Association for Retarded Citizens, North 37 degrees 25 minutes 55 seconds West 637.04 feet to a point; thence North 58 degrees East 372.55 feet to a point; thence North 55 degrees 45 minutes East 363 feet to a point, the place of BEGINNING. SAID tract containing 10.074 acres, more or less. BEING Lot No. 4-B on the above referenced subdivision plan. UNDER AND SUBJECT to all easements, encumbrances, rights of way and restrictions of record. SUBJECT to an easement across Lot No. 4-B to Lot No. 4-A for the installation of a sewer line from the existing sanitary sewer line at the eastern boundary of Lot No. 4-B along a 40 foot width at the northern right of way line of Brackbill Boulevard.
