STIPULATION AGAINST LIENS
THIS AGREEMENT made this C/? , day oft , r,:iZ 1999, by and between
D. CULLY, INC., D/B/A C & C CONSTRUCTION, A Pennsylvania Corporation,
hereinafter referred to as Contractor,
AND
TIMOTHY M. SIWY AND INGRID J. SIWY, husband and wife, hereinafter referred to
as Owner, whereby the contractor undertook and agreed to erected and
construct a dwelling on the certain lot of ground situate in West Pennsboro
Township, Cumberland County, Commonwealth of Pennsylvania, and more fully
described in Exhibit "A" which is attached hereto and made a part hereof
known as Lot 42 Greystone Acres, Carlisle, PA 17013.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor,
for an in consideration of the sum of ($1.00) Dollar to Contractor in hand paid by
Owner, the receipt whereof is hereby acknowledged, and the further
consideration mentioned in the agreement aforesaid, for itself, himself or
themselves and its, his or their subcontractors, and all parties acting through or
under them, covenant and agree that no mechanic's liens or claims shall be
filed or maintained by them or any of them against the said buildings and the lot
of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards,
in, or about the erection and construction of the said buildings on the lot above
described, and the said Contractor, for itself, himself or themselves, its, his or their
subcontractors and others under them, hereby expressly waive and relinquish
the right to have, file, and maintain any mechanic's liens or claims against the
said buildings or any of them, and agree that this instrument, waiving the right of
lien, shall be an independent covenant.

Exhibit A
ALL THAT CERTAIN tract of land situate in West Pennsboro Township,
Cumberland County, Pennsylvania, bounded and described in accordance with
Final Subdivision Plan of Greystone Acres consisting of 9 (9) sheets prepared by
Louis J. Harford, Registered Surveyor, dated June 14, 1996, a copy of which was
recorded in the hereinafter named Recorder's office in Plan Book 72, Page 70,
which Plan is incorporated herein by reference, as follows:
BEGINNING at a point on the southern line of 50 feet wide Kengrey Drive at the
dividing line between lots numbers 42 and 43; thence from said point at the Place of
BEGINNING along the southern line of said Kengrey Drive, South 77 degrees 05
minutes 46 seconds East a distance of 287.57 feet to a point at the dividing line
between lots numbers 41 and 42; thence along said dividing line between said lots
numbers 41 and 42 South 12 degrees 54 minutes 15 seconds West a distance of
306.75 feet to a point in line of land now or formerly of Dean E. and Nikki F.
Chamberlin; thence along line of said land now or formerly of Dean E. and Nikki F.
Chamberlin North 76 degrees 56 minutes 58 seconds West a distance of 287.57 feet
to a point at the dividing line between said lots numbers 42 and 43; thence along
said dividing line between said lots numbers 42 and 43, North 12 degrees 54 minutes
15 seconds East a distance of 306.02 feet to a point on the southern line of 50 feet
wide Kengrey Drive at the Place of BEGINNING.
THE ABOVE described lot of land is all of lot number 42 as shown on said final
subdivision plan for Greystone Acres, recorded in Plan Book 72, Page 70, and
contains an area of 2.02 acres, more or less.
BEING the same premises which Albert C. Kuhn and Edith B. Kuhn, husband and
wife, by Deed dated September 14, 1999, which Deed is recorded in the Office of the
Recorder of Deeds in and for Cumberland county in Deed Book 207, Page 883,
granted and conveyed to Timothy M. Siwy and Ingrid J. Siwy, husband and wife,
Borrowers herein.
