to remove the tree branches. Strict proof of Plaintiffs averment is demanded at trial.

6. Plaintiffs Complaint is barred by the doctrine of consent in that Plaintiffs live-in
girlfriend. Deborah Blosnich, consented to Del'endani s conduct after permission was sought.
7. Plaintifl-s Complaint is barred by the doctrine of estoppel in that Plaintiffs live-in
girlfriend. Deborah 131osnich, was I'ally aware of Defendant's actions and allowed said actions
to lake place without taking any steps to terminate Delcndant's actions.

AND NO\\'. comes the Plaintiff. Steven A. Rolfe, by and through his attorney. Richard
L. Placey. and sets forth the following:
Plaintiff. Steven A. Wolfe. is all adult individual and is the owner of the property
in Monroe Township. Cumberland County, Pennsylvania. having it street number of 820
Pairtfeld Street. JecIlanicsbUrg. Pennsylvania 17055.
2. Defendant. Gary Kopperman, is all adult individual having a place of business
known as the Restoration Clinic situate at 5222 E. Trindle Road. Mechanicsburg. Cumberland.
Pennsylvania 17055.
3. On or about August 7. 1999. Defendant. Gary Koppennan. without the permission
or consent ol'the Plaintiff. Steven A. Wolfe, trespassed upon Plaintifffs aforesaid property by
entering upon it and removed the lower eight (8) to ten (10) feet of branches from thirteen (13)
mature pine trees located at the rear of Plaintitf-s property.
4. As a result of Defendant's trespass and actions. the lair market value of Plaintiffs
property was reduced by Thirteen Thousand ($"13.000.00) Dollars.
WHEREFORE Plaintiff. Steven A. Wolfe, demandsjudgment against the Defendant,
Gary Kopperman, in the amount of Thirteen 'T'housand (S 13.000.00) Dollars, plus interest and
costs.

AND NOW, conics the Plaintiff, Steven A. Wolfe, by and through his attorney, Richard
L. Placey, and replies to the New Matter set forth in Defendant's Answer With New Matter, as
follows:
Plaintiff specifically denies the averments set forth in Defendant's Answer that
Defendant had permission or consent to remove the tree branches.
6. Plaintiff denies that Deborah Blosnich consented to Defendant's removal of the
tree branches subject of this proceeding.
Plaintiff denies that Deborah Blosnich was fully aware of Defendant's actions and
intentions. By may of further reply, Plaintiff avers that Deborah Blosnich had no authority to act
on Plaintiffs behalf with regard to Defendant's actions subject of this matter.
WIIEREFORE. Plaintiff, Steven A. Wolfe, demands judgment against the Defendant,
Gary Kopperman, as set forth in Plaintiffs Complaint.
