HOUPT, hereinafter referred to as Owner, whereby the former undertook and agreed to erect and construct a single family dwelling on that certain lot of ground situate in 12 Cedar View, Carlisle, PA 17013, North Middleton Township, Cumberland County NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said contractor, for and in consideration of the sum of ($1.00) Dollar to contractor in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves and their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. Houpt (Seal) .4 ALL THAT CERTAIN piece or parcel of land situate in North Middleton Township, Cumberland County, Pennsylvania, bounded and described as follows: BEGINNING at an iron pin on a cul-de-sac at the southern end of Cedar View at the dividing line between Lot No. 93 and Lot No. 94 on the hereinafter mentioned Plan of Lots; thence by Lot No. 93 South 21 degrees 30 minutes 16 seconds East 125.73 feet to an iron pin at lands now or late of North Middleton Township; thence by the same South 73 degrees 44 minutes 05 seconds West 205.23 feet to a concrete monument; thence by other lands of Fred A. Gettys North 11 degrees 48 minutes 13 seconds West 29.36 feet to an iron pin; thence by Lot No. 95 North 35 degrees 47 minutes 29 seconds West 187.00 feet to an iron pin on the cul-de-sac first mentioned; thence along the cul-de-sac by a curve extending to the left in an eastwardly direction and having a radius of 50 feet an arc distance of 50.00 feet to the place of BEGINNING. UNDER AND SUBJECT to a 20 foot utility easement along the eastern side of the lot and to a 30 foot utility easement along the southern side of the lot as is more fully shown on the recorded Plan. CONTAINING 19,276.83 square feet. UNDER AND SUBJECT, also, to all restrictions, reservations, conditions, and easements set forth on the recorded Plan of Lots or appearing in prior instruments of record. BEING Lot No. 94 on a Final Subdivision Plan for North Ridge, Phase II, made by Hartman and Associates, Inc., for Fred Gettys and recorded in Cumberland County Plan Book 76, Page 74 - .5 3 J J?
