NOW, THEREFORE, in consideration of the covenants contained in
said contract, and of $1.00 and other good and valuable
consideration, it is hereby stipulated and agreed by and between
said parties as part of said contract that there shall be no lien
or right to file a lien, against the property, or any part or parts
thereof, for work or labor done or materials furnished in the
performance of the work embraced in said contract, or any part or
parts thereof, or extra work thereunder or changes made therein;and
that no such lien be or claim shall be filed, or in any way
attempted to be enforced by, or on behalf of, the Contractor, or by
or on behalf of, any subcontractors, material men or other person
concerned in or about the performance of work embraced in said
contract, nor shall there by any claim for work or materials
against the Owner, his heirs, executors, administrators or assigns,
other than the legal claim of the Contractor as provided in said
contract.
AND, in order to give the Owner full power and authority to
protect itself and the Improvements and the Premises against any
and all claims filed by Contractor, or by any subcontractor or
anyone acting under or through Contractor in violation of the
foregoing covenant, Contractor, for itself, its successors and
assigns, and all such persons, hereby irrevocably authorizes and
empowers any attorney of any Court of Common Pleas of the
Commonwealth of Pennsylvania to appear for it,them, or any of
them, in any such Court as attorney for it or them, and in his, its
or their name, mark satisfied of record at the cost and expense of
Contractor or of any such subcontractor, laborer or materialmen any
such claim or mechanics, lien or judgment thereon entered in its or
their names against the Improvements or the Premises or any parts
thereof and for such act or acts this shall be good and sufficient
warrant and authority and a reference to the Court and to the
docket in which and where this Agreement shall have been filed
shall be a sufficient exhibit of the authority herein contained to
warrant such action, and the Contractor, for itself and all
subcontractors, laborers and materialmen, does hereby release all
errors and defects whatsoever in the entry of any such satisfaction
or the exercise of the authority hereby conferred.
It is the full intent of the Contractor, for himself and for
any subcontractors or material men claiming for themselves, or by,
through or under the contract, that the right to file a mechanics'
lien, under the provisions of Acts of Assembly in such cases made
and provided, for work done or materials furnished in and about the
erection, construction, alteration, or repairs of the building and
improvements above described, is hereby waived.
IN WITNESS WHEREOF, the parties to these presents have
hereunto set their hands and seals, the day and year first above
written.

Pennsylvania, more particularly bounded and described as follows:
BEGINNING at a concrete monument on he right-of-way line of Township Road 435 known as
Beecher Drive which point is also in the northwest corner of land now of formerly of James B.
Beecher; thence along the lands now or formerly of Beecher South 55 degrees 57 minutes 53
seconds East, 200.43 feet to an iron pin in the line of other lands of the Grantors herein; thence
along the lands of the Grantors herein South 37 degrees 51 minutes 01 seconds East 100.93 feet
to a concrete monument on the right-of-way line of Beecher Drive; thence along the right-of-way
line of Beecher Drive by a curve to a left with a radius of 60 feet an arc distance of 56.88 feet,
the chord of said curve having a bearing of North 65 degrees 00 minutes 26 seconds East and
length of 54.77 feet to a point; thence continuing along the right-of-line of Beecher Drive North
37 degrees 51 minutes 01 seconds East, 87 feet to a concrete monument at the Place of
BEGINNING.
