STIPULATION AGAINST LIENS WHEREAS, TAM VAN AND HOA VAN, husband and wife, ("Owners"), the Owners of the real estate described below, has or is about to execute a General Contract with JAMES DIANA t/d/b/a HUNTERS RUN CONSTRUCTION, a sole proprietorship, ("Contractor'), whose principal place of business is located at 183 Faith Circle, Carlisle, Pennsylvania, for improvements upon 144 North Spring Garden Street, Borough of Carlisle, Cumberland County, Pennsylvania and more particularly bounded and described on Exhibit "A", attached hereto and made a part hereof; and NOW', THEREFORE, this n1 day of November, 1999, before any authority had been given by Owners to Contractor to commence work on said facilities or purchase materials for same, in consideration of making of the above-described Contract with Owners, and in further consideration of One ($1.00) Dollar paid to Contractor by Owners, the receipt whereof is hereby acknowledged, it is agreed that no liens or claims shall be filed or maintained against the Owners' facilities and the land above-described by the Contractor or any of its subcontractors, or by any of the materialmen or workmen, or any other person acting through or under them, for or on account of any labor or materials purchased, or extra labor or materials purchased for, towards, in or abut the erection, construction, design and improvement of said facilities, under said contract or otherwise, the right to have, file and maintain such liens or claims against the facilities and the land above-described, being hereby expressly waived by the Contractor for itself, its subcontractors, all materialmen, or workmen and other acting through or under them. r7= IN WITNESS WHEREOF, each of the parties, by their duly authorized representatives, have hereunto executed the Stipulation Against Liens this lcr/A day of November, 1999. Forney and wife; thence along the latter land, Westwardly 62 feet to a point on the line of land now or formerly of Kenneth E. Barrick and wife; thence along the latter land, Northwardly 49 feet to a point on the same; thence by the same, Eastwardly 62 feet to a point on the Western side of North Spring Garden Street; thence by the latter, Southwardly 49 feet to the place of BEGINNING. EXCEPTING, however, so much of the above described tract of land as was conveyed by Andrew K. Carothers, et ux, to Kenneth E. Barrick and Pauline M. Barrick, his wife, by deed dated and recorded in Deed Book "F", Vol. 15, Page 265. BEING subject, however to a reserved right in favor of Kenneth E. Barrick and Pauline M. Barrick, his wife, their heirs and assigns, to continue to use the existing pipe leading from their dwelling house to the cesspool on land retained by them, which pipe crosses the rear of the land conveyed herein and together with a right to enter to repair and relay said pipe when necessary. NOW KNOWN AND NUMBERED as 144 North Spring Garden Street, Carlisle, Cumberland County, Pennsylvania. BEING the same premises that Robert W. Belyea and Arleen P.
