PETITION FOR WAIVER OF THE PUBLICATION REQUIREMENTS OF
CUMBERLAND COUNTY RULES OF PROCEDURE 5
The Petitioner, Joanne H. Painter, by her attorneys, the Family Law Clinic, hereby
petitions this Honorable Court to enter an Order waiving the requirements of publication set
out in C.C.R.P. 5, and respectfully represents that:
1. The Petitioner is Joanne Helen Painter, an adult who lives at 2200 Ritner Highway,
Shippensburg, Cumberland County, Pennsylvania, 17257.
2. Concurrent with the filing of this Petition, Petitioner filed a petition for a name
change on behalf of her minor daughter, Desiree Catherine Helen Wilson, hereafter (Desiree"),
who was born on May 15, 1998, in Harrisburg, Dauphin County, Pennsylvania.
3. Rule 5 of the Cumberland County Rules of Procedure requires that a petitioner in a
name change case give notice of the filing of the petition and of the hearing thereon by
publication in two newspapers.
4. Rule 5 also requires that such notice be given to the non-petitioning parent of a
minor child.
5. Given her age, Desiree is legally incapable of contracting debts or incurring liability
for torts.
6. Petitioner is proceeding in this matter in forma pauperis and cannot afford the costs
of publication.
7. Desiree's Father, Kevin Elias Wilson, who is the only other interested party in this
matter, will be served by actual service.
8. Petitioner's cause of action is meritorious but could not proceed unless the relief
requested here is granted.
WHEREFORE, Petitioner respectfully requests that this court waive the requirements
of publication under C.C.R.P. 5.

The Petitioner, Joanne H. Painter, by her attorneys, the Family Law Clinic, hereby
petitions this Honorable Court to enter a decree changing her minor daughter's name from
Desiree Catherine Helen Wilson to Desiree Joanne Helen Painter, and respectfully represents
that:
1. The Petitioner is Joanne Helen Painter, who lives at 2200 Rimer Highway,
Shippensburg, Cumberland County, Pennsylvania.
2. Petitioner is the mother of Desiree Catherine Helen Wilson (hereafter "Desiree"),
who was born on May 15, 1998, in Harrisburg, Dauphin County, Pennsylvania. Desiree's
social security number is 177-78-5658. A true copy of Desiree's birth certificate is attached
as Exhibit A and is incorporated here by reference.
3. Desiree's father is Kevin Elias Wilson ("father"), who lives at 3512 Enola Road,
Newville, Cumberland County, PA.
4. Petitioner avers that it is in the best interest of Desiree Catherine Helen Wilson to
have her name changed to Desiree Joanne Helen Painter, because:
a) Father has had no contact with Desiree since November 1998, and has, in fact,
avoided contact with his child.
b) Petitioner is also the mother of James Robert John Painter, born January, 28 1985,
and Samantha Joanne Ruth Painter , born January 9, 1987, who are Desiree's half siblings,
Joanne and Samantha live with the petitioner and Desiree.
5. Since the child's birth, Petitioner and Desiree have lived at their current address,
2200 Rimer Highway, Shippensburg, PA. 17257.
6. There are no judgments, liens, decrees or the like against Desiree Catherine Helen
Wilson or Desiree Catherine Helen Painter.
WHEREFORE Petitioner prays that the Court:
a) Set a time and place for a hearing on the above-captioned matter;
b) Direct Petitioner to serve this Petition and the attached Order on Kevin Elias
Wilson;
c) After said hearing, enter an Order changing the name of Desiree Catherine Helen
Wilson to Desiree Joanne Helen Painter; and
d) Grant such other relief as may be just.

AND NOW, April 8, 1999, 2:27 p.m., after hearing and
consideration of the testimony presented, we do make the Rule
absolute and we do find the defendant to be in contempt of
court. We find that since his last major payment in December of
$350.00, the defendant has made two payments, one of $35.00 and
one of $80.00, from that time.
Having found the defendant to be in contempt of court,
we sentence him to a term of imprisonment in the Cumberland
County Prison of three months. We give him an opportunity to
purge himself of that contempt and of that jail sentence by
paying the sum of $700.00 on the accrued arrears and by making
his regular weekly payments, including arrears, each week

PETITIONER'S PRE-HEARING MEMORANDUM
Procedural Historv
Petitioner, Joanne Painter, hereafter "mother", seeks to change the name of her two year
old daughter, Desiree Catherine Helen Wilson, born May 15, 1998, hereafter called "daughter",
to Desiree Joanne Helen Painter. A hearing is scheduled for Monday, April 3, 2000. The non-
petitioning parent, Kevin Elias Wilson, hereafter "father," was served by the Cumberland
County Sheriff on March 1, 2000.
Ouestion Presented
Whether it is in the best interest of daughter for the Court to change her last name
from that of her father to that of her mother, where the father has no relationship
whatsoever with daughter, has not lived with the daughter since she was three and a half months
old, is in arrears in child support approaching one thousand dollars, where mother has cared
for daughter throughout her life, and where daughter lives with two half siblings who have the
same surname as that of mother, leaving daughter as the only household member with a different
surname?
Statement of Pacts
Mother will present the following facts at the hearing:
Father has not bonded with daughter. Between May and September, 1998, father was
rarely involved in raising his daughter. In fact, mother gave birth to daughter via a C-section and
was in great pain after her birth. Yet, father did not help take care of daughter. He moved out of
the family home in late August or early September, 1998, when daughter was approximately
three and a half months old. Father has continued to show little interest in daughter since lie left.
Mother brought daughter to visit his home on several occasions in late 1998, but father was more
interested in watching television than interacting with his daughter. After November, 1998,
father never saw daughter again. Mother made a few attempts to encourage visitation, but father
either declined the offer or simply did not show up. These attempts include Christmas Day,
1998, when father told mother he did not want to see daughter because of a party he was going to
attend. Then in March 1999, mother set up a lunch visit between father and daughter. Mother
and daughter waited for over four hours at the designated meeting spot, but father did not
appear nor did he call to cancel. From that point on, mother has not tried to initiate visits
between father and daughter, inasmuch as father has made no attempts to visit his daughter.
When mother informed father of her plan for daughter's name change, father offered to consent if
mother returned some furniture of his that she still allegedly had in her house. From this point
on, mother has made no contact with father. Father owes mother nearly one thousand dollars in
child support arrears. Father has never sent daughter any Christmas cards or presents.
Additionally, father did not acknowledge daughter's first birthday. Father has never taken
daughter for a doctor's visits. Daughter has no idea who her father is. Daughter lives in
mother's home with her two half-siblings. Mother and both half-siblings have the last name
"Painter," leaving daughter as the only member of the household with a different last name.
Ar ug ment
In In Re Chanee of Name of Zachary Thomas Andrew Grimes to 7achery Thomas
Andrew Grimcs-Palaia, 609 A .2d 158 (1992), the Supreme Court of Pennsylvania adopted the
best interest of the child as the standard for granting a minor child's name change. The Court
further held that it is the petitioner's burden to demonstrate that such a name change is in the
child's best interest.
In Grimes, the Supreme Court stated that each name change is unique, "as each child has
individual physical, intellectual, moral, social and spiritual needs." Grimes at 161. The Court set
out three general considerations. First, courts should consider "the natural bonds between parent
and child." Second, courts should consider "the social stigma or respect afforded a particular
name within the community." The final factor is age dependent. "Where the child is of
sufficient age, whether the child intellectually and rationally understands the significance of
changing his or her name" is important to consider. Id. at 161.
In Grimes, the Court decided that a name change was not in Zachary's best interest.
Turning to the first factor, Zachary's biological father was actively involved in his life. The trial
court had acknowledged the two had close bonds with each other. As for the second factor,
there was no evidence of any social stigma with the name "Grimes." Petitioner also failed on
the third factor. Zachary had the capability to testify, yet petitioner chose not to have him testify.
A name change affects more than just the child. It also affects the non-petitioning parent,
especially if he has a bond with that child.
The case at bar is factually distinct from Grimes. Unlike Grimes, the first factor, the bond
between parent and child, is non-existent in this case. Father has never attempted to form a bond
with daughter. He has not had any contact with her for over a year.

Additionally, daughter has lived with mother and her half siblings since birth. Hence, she solely

identif ics with them. Yet, she is the only family member who does not share her mother's
surname. Father, by his own choosing, is a stranger to his own daughter.
Grimes has been applied at least twice by the Cumberland County Courts in opinions by
Judge Oler. In In re: Rodger T. Atwood III, 42 Cumb. 264 (1992), Judge Oler reiterated the three
factors discussed in Grimes, but also made mention of other factors to consider. These include a
child's preference, the effect of a proposed name change on the preservation and development of
the child's relationship with each parent, duration of the child's usage of his or her surname and
the distinction and notoriety possessed by a name. Judge Oler declined to change Theodore
Atwood's name because Mr. Atwood had a good relationship with his son Theodore. He helped
raise him for four years, had visitation rights, and continually wrote his son letters while in
prison. Even more, he expressed a strong desire to continue this relationship once out of prison.
Hence, if Theodore lost the name "Atwood," a link to his caring father would be forever severed.
Mr. Atwood was proud of his son and wanted the world to know this. Severing Theodore's last
name would impede this wish.
In Chance of Name of Nathan Trevor Armold C P , 43 Cumb. 525 (1994), Judge Oler
granted a child's name change where the child never used the name of the natural father, but was
instead given the mother's maiden name at birth.
In the case at bar, there is no father/daughter relationship. Father has made no real efforts
to contact mother in regards to daughter. Additionally, father has never sought any custodial
rights. Grimes and Atwood both involved fathers who had bonded with their children.
With regard to the second Grimes factor, although father has a criminal
record in both Cumberland and Huntingdon County, mother does not primarily rely upon this
record in seeking a name change for her daughter.
With regard to the third Grimes factor, daughter has only had her current surname for
less than two years. Being only 22 months old, she is unaware of her surname. In Atwood and
Grimes, both children were school aged and thus aware of their identity.
It is in daughter's best interest to receive the requested name change. Her father has no
relationship with her whatsoever. Additionally, daughter is the only family member in her
household to have a surname other than Painter. As site gets older and enters pre-school and
school, this situation will inevitably raise questions and create problems for her. Finally, daughter
is not even aware of her surname. Father has had plenty of opportunity to bond with his
daughter; he has chosen not to do so.
