execute contemporaneously herewith a contract with ,i S CONSTRUCTION INC., for (lie

Now, 12-11 19.c1 , 1999 at the time of and immediately before the execution of the
principal contract, and before any authority has been given by the said owners to the said
contractor to commence work on the said building, or purchase materials for the same in
consideration of the making of the said contract with contractor and the further consideration of
One (61.011) Dollar to contractor paid by owner, it is agreed that no lien shall be filed against the
building and/or land by the contractor, or any subcontractor, nor by any of the material men or
workmen or any other person for any labor, or materials purchased, or extra labor or materials
purchased for the erection of said building, the right to file such liens being expressly waived.

The land referred to in this Commitment is described as follows:
ALL THAT CERTAIN tract or parcel of land being situate in Upper Allen
Township, Cumberland County, Pennsylvania, more particularly bounded and
described as follows, to wit:
BEGINNING at a point on the eastern right of way line of Cope Drive (South), a
50 foot wide street, said point being the northwestern corner of Lot No. 184;
thence along said right of way line along a curve to the left having a radius
of 200.00 feet an arc length of 20.14 feet, said arc being subtended by a
chord of North 27 degrees 48 minutes 00 seconds West a distance of 20.13 feet
to a point; thence continuing along said right of way line North 30 degrees 41
minutes 05 seconds West a distance of 59.74 feet to a point; thence continuing
along a curve to the right having a radius of 10.00 feet an arc length of
15.71 feet, said arc being subtended by a chord of North 14 degrees 18 minutes
SS seconds East a distance of 14.14 feet to a point on the southern right of
way line of Glime Drive, a 50 foot wide street; thence along said right of way
line North 59 degrees 18 minutes 55 seconds East, a distance of 93.34 feet to
a point, said point being on the western line of lands NIF the remaining lands
of Ashcombe Farms PRO Phase 3A; thence along the western line of said lands
South 30 degrees 41 minutes 05 seconds East a distance of 100.39 feet to a
point, said point being on the northern line of Lot No. 184; thence along the
northern line of said lot South 65 degrees 05 minutes 06 seconds West a
distance of 104.89 feet to a point, the Place of BEGINNING.
