HomeMy WebLinkAbout99-07464019. 7y/ y "V41) STIPULATION AGAINST LIENS THIS AGREEMENT made this C.L day ofQ?1f31 1999 by and between SHERIFF BUILDERS, INC., a Corporation, hereinafter referred to as Contractor, AND DEREK D. JARDINE AND JANE T. JARDINE, husband and wife, hereinafter referred to as Owners, whereby the contractor undertook and agreed to erected and construct a dwelling on the certain lot of ground situate in West Pennsboro Township, Cumberland County, Commonwealth of Pennsylvania, and more fully described in Exhibit "A" which is attached hereto and made a part hereof known as Lot #26 Greystone Acres, Carlisle, Cumberland County, PA. NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for an in consideration of the sum of ($1.00) Dollar to Contractor in hand paid by owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for itself, himself or themselves and its, his or their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for itself, himself or themselves, its, his or their subcontractors and others under them, hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. I .. ? fit..,. ? 1 Exhibit A ALL THAT CERTAIN tract of land situate in West Pennsboro Township, Cumberland County, Pennsylvania, bounded and described in accordance with Final Subdivision Plan for Greystone Acres consisting of nine (9) sheets prepared by Louis J. Harford, Registered Surveyor, dated June 14, 1996, a copy of which was recorded in the hereinafter named Recorder's Office in Plan Book 72, Page 70, f which Plan is incorporated herein by reference, as follows: j BEGINNING at a point on the southern line of 50 feet wide Pennway Drive at the dividing line between Lots Nos. 26 and 27; thence from said point at the Place of BEGINNING along said southern line of 50 feet wide Pennway Drive, South 77 degrees 15 minutes 13 seconds East a distance of 210.00 feet to a point at the dividing line between Lots Nos. 25 and 26; thence along said dividing line between said Lots No. 25 and 26 South 05 degrees 45 minutes 00 seconds West a distance of 379.43 feet to a point on the northern line of Lot No. 29; thence along a portion of the northern line of said Lot No. 29, North 86 degrees 06 minutes 16 seconds West a distance of 259.29 feet to a point at the dividing line between Lots Nos. 26 and 28; thence along said dividing line between Lots Nos. 26 and 28 and continuing along the dividing line between Lots Nos. 26 and 27, North 12 degrees 44 minutes 48 seconds East a distance of 416.50 feet to a point on the southern line of 50 feet wide Pennway Drive at the Place of BEGINNING. THE above described lot of land is all of Lot No. 26 as shown on said Final Subdivision Plan for Greystone Acres, recorded in Plan Book 72, Page 70, and contains an area of 2.13 acres, more or less. BEING the same premises which Albert C. Kuhn and Edith B. Kuhn, husband and wife, by Deed dated November 14,1999, which Deed is recorded in the office of the Recorder of Deeds in and for Cumberland County in Deed Book 211, Page 899 , granted and conveyed to Derek D.
