STIPULA TI®N A GAINST LIENS
THIS AGREEMENT made the 13th day of December, 1999, by and between RIDGEV IEW
CUSTOM HOMES, hereinafter referred to as Contractor, and HERBERT G. WEAVER, hereinafter
referred to as Owner, whereby the former undertook and agreed to erect and construct a custom built
home on that certain lot of ground situate at Lot No. 96, Indian Hills-Section 2, South Middleton
Township, Cumberland County, Pennsylvania, more fully described in Exhibit "A" attached hereto
and made a part hereof.
NOW THEREFORE, WITNESSETH: That the said Contractor, for and inconsideration of
the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves
and their subcontractors, and all parties acting through or under them, covenant and agree that no
mechanic's liens or claims shall be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or about the
erection and construction of the said buildings on the lot above described, and the said Contractor,
for themselves, their subcontractors and others under them hereby expressly waive and relinquish
the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any
of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant.

as such owner, being authorized to do so, executed the foregoing statement for thepurposes therein
contained by signing the name of the business by himself as the owner.

EXHIBIT "A"
ALL that certain tract of land situate in South Middleton Township, Cumberland County,
Pennsylvania, and more particularly identified as follows:
BEGINNING at an iron pin on the southern right-of-way line of Shirley Drive (50 foot wide right-
of-way) at the dividing line between Lot No. 96 and Lot No. 97 of the aforementioned plan; thence
along said Shirley Drive North 86 degrees 41 minutes 44 seconds East a distance of 100.69 feet to
an iron pin at the dividing line between Lot No. 95 and Lot No. 96; thence along said dividing line
South 03 degrees 18 minutes 16 seconds East a distance of 156.77 feet to an iron pin; thence South
88 degrees 49 minutes 27 seconds West a distance of 100.76 feet to an iron pin at dividing line
between Lot No. 96 and Lot No. 97; thence along said dividing line North 03 degrees 18 minutes 16
seconds West a distance of 153.03 feet to an iron pin on the southern right-of-way line of Shirley
Drive, the point and place of BEGINNING.
CONTAINING 15,596.66 square feet and being Lot No. 96 of the aforementioned subdivision plan.
