STIPULATION AGAINST LIENS

THIS AGREEMENT made the ) day of S e o T. 1999,
by and between dewcome 11-T.-lPc-A
(hereinafter referred to as "CONTRACTOR"), and CARL B. BERT &
THELMA E BERT, husband and wife (hereinafter referred to as
"OWNER"). The OWNER is acting as their own General Contractor
concerning the hereinafter referred to property, and the OWNER AND
CONTRACTOR have entered into an agreement (herein "AGREEMENT")
whereby the C//ON/TR/ACTOR undertook and agreed to do the following

on the repair and ren vation of the building of
OWNER'S, which is situated on that certain lot of ground owned by
OWNER and situate in the Borough of Shippensburg, Cumberland
County, Pennsylvania, which is known as 20 East Burd Street and
more particularly described in Deed dated December 29, 1993, and
recorded in the office of the Recorder of Deeds in and for
Cumberland County, Pennsylvania, in Deed Book "T" Vol. 36, Page
1008, (herein "The Property".)
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the
CONTRACTOR, for and in consideration of the sum of ($1.00) Dollar
to CONTRACTOR in hand paid by OWNER, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the above
referred to Agreement between the parties, for CONTRACTOR and all
of CONTRACTOR'S subcontractors (and all parties acting through or
under it, him or them), covenants and agrees that no mechanic's
liens or claims shall be filed or maintained by it or them or any
of them against the building(s) and The Property upon which the
building is situated (as referred to above) for or on account of
any work done or materials furnished by it or them or any of them
under the Agreement or otherwise, for, towards, in, or about the
repair and renovation of the building(s) on The Property, and the
CONTRACTOR, for itself, themselves, their subcontractors and
others under them, hereby expressly waive and relinquish the right
to have, file, and maintain any mechanic's liens or claims against
the buildings or The Property, and agree that this instrument,
waiving the right of lien, shall be an independent covenant.
