CIVIL ACTION - LAW NO. RALPH SLOTTEN, Defendant JURY TRIAL DEMANDED COMPLAINT 1. Plaintiff Shandor Maszle is an adult individual who presently resides in Hilton Head Island, South Carolina. At the time of the subject accident described herein, Mr. Maszle resided in Mount Holly Springs, Cumberland County, Pennsylvania. 2. Defendant Ralph Slotten is an adult individual who resides at 1337 Georgetown Circle, Carlisle, Cumberland County, Pennsylvania. 3. The facts and occurrences hereinafter related took place on or about March 11, 1998, at approximately 7:30 a.m. on Glendale Street, at the intersection of Glendale Street and Hillside Drive, Carlisle, Cumberland County, Pennsylvania. 4. At that time and place, Plaintiff Shandor Maszle was a front seat passenger in a 1987 Volkswagen Gulf being operated by Fletcher Parker. 5. Mr. Parker was travelling north on Glendale Street. 6. At the same time, Defendant Ralph Slotten was operating a 1993 Ford Taurus on Hillside Drive. 7. Defendant Slotten stopped his vehicle at the stop sign at the intersection of Glendale and Hillside. 1 11 g. As Mr. Parker's vehicle approached the subject intersection, Defendant Slotten pulled directly in front of Mr. Parker's vehicle, causing the collision. 9. The foregoing accident and all of the injuries and damages set forth hereinafter sustained by Shandor Maszle are the direct and proximate result of the negligent, careless, wanton and reckless manner in which Ralph Slotten operated his motor vehicle as follows: a. failure to keep alert and maintain a proper watch for the presence of other motor vehicles on the highway; b. failure to yield the right-of-way to Plaintiff's vehicle; C. failure to keep a proper watch for traffic on the roadway; d. failure to keep proper and adequate control over his vehicle; and e. driving his vehicle upon the highway in a manner endangering persons and property and in a reckless manner with careless disregard to the rights and safety of others and in violation of the Motor Vehicle Code of the Commonwealth of Pennsylvania. CLAIM I Shandor Maszle v Ralph Slotten lo. Paragraphs 1 through 9 of the Complaint are incorporated herein by reference. 11. Plaintiff Shandor Maszle sustained painful and severe injuries which include but are not limited to multiple abrasions, and two forehead lacerations, one two centimeters and the other one centimeter. t. ii. By reason of the aforesaid injuries sustained by Plaintiff Shandor Maszle, he was forced to incur liability for medical treatment, and similar miscellaneous expenses in an effort to restore himself to health, and claim is made therefor. 13. Because of the nature of his injuries, Plaintiff Shandor Maszle has been advised and, therefore, avers that he may be forced to incur similar expenses in the future, and claim is made therefor. 14. As a result of the aforementioned injuries, Plaintiff Shandor Maszle has undergone and in the future may undergo physical and mental suffering, inconvenience in carrying out his daily activities, loss of life's pleasures and enjoyment, and claim is made therefor. 15. As a result of the aforesaid injuries, Shandor Maszle has been and in the future may be subject to humiliation and embarrassment, and claim is made therefor. 17. Plaintiff Shandor Maszle has permanent scarring which may cause residual problems for the remainder of his lifetime, and claim is made therefor. WHEREFORE, Plaintiff Shandor Maszle demands judgment against Defendant Ralph Slotten in an amount in excess of Twenty-Five Thousand ($25,000.00) Dollars, exclusive of interest and costs and 3 i > i in excess of any jurisdictional amount requiring compulsory arbitration.
