At the time that Defendant sold her home to the Morgeneiers., Defendant filled out a Property Disclosure Statement ('Property Disclosure"), a copy of which is attached hereto as Exhibit A and incorporated herein by reference. 4. As part of the Disclosure Statement, Defendant made no disclosures regarding the sewer drainage line. 5. Shortly after the Morgeneiers moved in to the Residence, they discovered severe plumbing problems. Specifically, water did not drain down the sewer line and through the sewer lateral to the sewer main in the street. 6. The Morgeneiers had Free Flow, a plumbing company come to the house on numerous occasions to try to fix the problem. Attached hereto as Exhibit B are invoices from plumbers totaling $435.00. 7. The Morgeneiers have had an estimate of approximately $5,000.00 to tear up the sewer lateral and replace it, which is the only solution that will rectify the clogged sewage line. B. When the Morgeneiers' plumber inspected the property, he noticed a cap on the sewer drain line in the basement. As a former employee of Rotor Rooter, he recognized the plug as one that was installed by Rotor Rooter. g. Defendant and her late husband lived in the Residence for many years and were well aware of the condition of the Residence. 10. On information and belief, Defendant knew that the sewer line was clogged and called Rotor Rooter to service the sewer on at least one occasion. 11. Defendant did not disclose this condition prior to settlement. 12. The Morgeneiers do not consent to mediation. 13. Defendant's, attorney-in fact, her son, William Oberdick, sold the Residence on Defendant's behalf. ELI Negligent tinia?nracantation 14. Defendant's statement in the Property Disclosure that there were no know problems with the plumbing was a negligent misrepresentation of a material fact. 17. The condition of the plumbing was a material fact that in part, induced the Morgeneiers to purchase the Residence. 18. Defendant and her attorney-in-fact knew or should have known of the condition of the sewer drain and knew or should have known that Defendant's statement regarding the drain was false. 19. Defendant's action was intended to induce the Morgeneiers to purchase the Residence. 20. The Morgeneiers justifiably relied on the Property Disclosure made by Defendant. 21. The Morgeneiers have been damaged in an amount not in excess of Twenty-Five Thousand and 00/100 ($25,000.00) Dollars, exclusive of interest and costs. -i f i J 22. The Complaint is barred by the Integration Clause of the Agreement of Sale which states: "It is understood that Buyer has inspected the Property before signing this Agreement of Sale (including fixtures and any personal property specifically scheduled herein), or has waived the right to do so, and has agreed to purchase it in its present condition unless otherwise stated in this Agreement. Buyer acknowledges that the Agents have not made an independent examination or determination of the structural soundness of the Property, the age or condition of the components, environmental conditions, the permitted uses, or of conditions existing in the locale where the Property is situated; nor have they made a mechanical inspection of any of the systems contained therein." 24. The Complaint is barred by the Release Clause of the Agreement of Sale which states: "Buyer hereby releases, quit claims and forever discharges SELLER, ALL AGENTS, their SUBAGENTS, EMPLOYEES, and any OFFICER or PARTNER of any one of them and any other PERSON, FIRM, or CORPORATION who may be liable by or through them, from any and all claims, losses or demands, including, but not limited to, personal injuries and property damage and all of the consequences thereof, whether now known or not, which may arise from the presence of termites or other wood- boring insects, radon, lead-based paint hazards, environmental hazards, any defects in the individual on-lot sewage disposal system or deficiencies in the on-site water service system, or any defects or conditions on the Property. This release shall survive settlement." 4 WHEREFORE, Defendant, Mildred B.
