THIS AGREEMENT made the 2?TH day of June, 2003
by and between WILLIAM H. GOODLING, d/b/a WILLIAM H. GOODLING CONSTRUCTION
hereinafter referred to as Contractor,
AND
WILLIAM H. GOODLING AND KELLY J. GOODLING, h/w
hereinafter referred to as Owner, whereby the former undertook and agreed to construct a
single family dwelling, in Lot #S1 4 Springview Court Mechanicsburg, Pa, Township of
Silver Spring, Cumberland County, more particularly described as in exhibit "A",
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and
in consideration of the sum of ONE (1.00) Dollar to it in hand
paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration
mentioned in the agreement aforesaid, for themselves and their subcontractors, and all
parties acting through or under them, covenant and agree that no mechanic's liens or
claims shall be filed or maintained by them or any of them against the said buildings and
the lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or
about the erection and construction of the said buildings on the lot above described, and
the said Contractor, for themselves, their subcontractors and others under them hereby
expressly waive and relinquish the right to have, file, and maintain any mechanic's liens
or claims against the said buildings or any of them, and agree that this instrument,
waiving the right of lien, shall be an independent covenant.

ALL THAT CERTAIN Lot in the property known, named and identified in the Declaration,
referred to below, as "Walnut Point, a Planned Community," located in Silver Spring
Township, Cumberland County, Pennsylvania, which has heretofore been submitted to the
provisions of the Pennsylvania Uniform Planned Community Act, 68 Pa.C.S,A. §§5101 e~t
seq., as amended, by the recording in the Office of the Recorder of Deeds of Cumberland
County, Pennsylvania, the Declaration for Walnut Point, a Flexible Residential Planned
Community ("Declaration"), dated June 17, 1998, recorded June 18, 1998, in
Miscellaneous Book 579, Page 882, as amended by First Amended Declaration for Walnut
Point, a Flexible Residential Planned Community ("First Amendment"), dated November 13,
2002, recorded November 14, 2002, in Miscellaneous Book 691, Page 3769 and
designated in such Declaration as Lot No. 51 (Identifying Number), described in Section
2.2 of the Declaration, as amended and shown (and described) in Exhibit C-1 of the First
Amendment.
CONTAINING 0.3876 acres.
BEING Lot No. 51, Final Subdivision Plan for Walnut Point Phase II dated June 14, 2002,
last revised November 16, 2002, recorded in the Office of the Recorder of Deeds of
Cumberland County, Pennsylvania, in Plan Book 85, Page 1.
BEING THE SAME PREMISES which Harold D. Stoner and Marilyn L. Stoner, h/w by
their Deed dated June 27, 2003 and about to be recorded in the Office of the
Recorder of Deeds in and for Cumberland County, Pennsylvania, granted and
conveyed unto William H. Goodling and Kelly J. Goodling, h/w Mortgagors herein.
