WHEREAS, VIVENCIO G. DEL ROSA-RIO and CARMEN O. DEL ROSARIO of
Pennsylvania , is about to execute contemporaneously
herewith, a contract, with CARLSON CONSTRUCTION, INC., of 1085 Country Club Road, Camp Hill,
Pennsylvania 17011, for the erection of a building upon premises commonly known as Lot 0-16
Floribunda Heights, East Pennsboro Township, Camp Hill, Cumberland County, Pennsylvania, as set forth
in the deed dated December , 1999, at Deed Book , Page , in the
Recorder's Office for Cumberland County, Pennsylvania, as more specifically described in Exhibit "A"
which is incorporated herein and attached hereto.
NOW, December , 1999, at the time of the execution of the principal contract, and before
any authority has been given by the said Owner to the said Contractor to commence work on the said
building, or purchase materials for the same in consideration of the making of the said contract with
Contractor and the further consideration of One Dollar (51.00), to Contractor paid by Owner, it is agreed
that no lien shall be filed against die building by the Contractor, or any subcontractor, nor by any of the
materialmen or workmen or any other person for any labor, or materials purchased, or extra labor or
materials purchased for the erection of said building, the right to file such liens being expressly waived.
WITNESS, our hands and seals the day and year aforesaid.

Exhibit "A"
ALL THAT CERTAIN piece or parcel of land situate in East Pennsboro Township,
Cumberland County, Pennsylvania, more particularly bounded and described as follows, to wit:
BEGINNING at a point on the eastern side of Cherish Drive at the southwestern corner
of Lot No. 0-15 on the hereinafter mentioned Plan of Lots; thence along the eastern side of Lot
No. 0-15, North 76 degrees I I minutes 47 seconds East, 162.34 feet to a point at the western line
of Plan of Floribunda Heights, Phase II, Section VII; thence along the said western line of Plan
of Floribunda Heights, Phase 11, Section VII, South 17 degrees 05 minutes 10 seconds East, 94.13
feet to a point at the northwestern corner of Lot No. 0-17 on the hereinafter mentioned Plan of
Lots; thence along the northern side of Lot No. 0-17, South 72 degrees 43 minutes 30 seconds
West, 166.54 feet to a point on the eastern side of Cherish Drive; thence along the eastern side
of Cherish Drive by a curve to the left having a radius of 225.00 feet and an arc length of 25.92
feet to a point; thence along the same eastern side of Cherish Drive, North 13 degrees 48 minutes
13 seconds West, 78.91 feet to a point, the point and place of BEGINNING.
CONTAINING 16,348.98 square feet.
BEING Lot No. 0-16, on the Final Plan of Floribunda Heights, Phase II, Section VIII,
and recorded in the Office of the Recorder of Deeds, Cumberland County, Pennsylvania, in Plan
Book 74, Page 33.
UNDER AND SUBJECT, NEVERTHELESS, to all easements, restrictions,
encumbrances and other matters of record or that which a physical inspection or survey of the
premises would reveal.
