HAUBERT HOMES, INC., Owner Contractor IN THE COURT OF COMMON PLEAS CUMBERLAND, PENNSYLVANIA NO. 9 9 - '772 L 1111-b WHEREAS, GARY L. WILKINS and DONNA J. WILKINS of 118 North 4th Street, Lemoyne, Pennsylvania, is about to execute contemporaneously herewith, a contract, with HAUBERT HOMES, INC. of 15 Central Blvd, Camp Hill, Pennsylvania, for the erection of a building upon premises commonly known as LOT 29 LONGFELLOW COURT, TOWNSHIP OF HAMPDEN NEW CUMBERLAND, CUMBERLAND County, Pennsylvania, as set forth in the deed dated September 3, 1999, recorded at Deed Book 207, Page 393, in the Recorder's Office for CUMBERLAND County, Pennsylvania, as more specifically described in Exhibit "A" which is incorporated herein and attached hereto. NOW, DECEMBER 28, 1999, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Owner to the said Contractor to commence work on die said building, or purchase materials for the same in consideration of the making of the said contract with Contractor and the further consideration of One Dollar ($1.00), to Contractor paid by Owner, it is agreed that no lien shall be filed against the building by the Contractor, or any subcontractor, nor by any of the materialmen or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. WILKINS EXHIBIT "A" ALL THAT CERTAIN tract or parcel of land being situate in Lower Allen Township, Cumberland County, Pennsylvania, more particularly bounded and described as follows.to wit: BEGINNING at a point on the northwestern right-of-way line of Longfellow Court, a 40 foot wide street, said point being the northeastern corner of Lot No. 30; THENCE along the northern line of said lot North 66 degrees 29 minutes 50 seconds West a distance of 153.00 feet to a point, said point being on the southern right-of--way line of Lowell Lane, a 50 foot wide street; THENCE along said right-of-way line along a curve to the right having a radius of 125.00 and an are length of 101.50 feet, said arc being subtended by a chord of North 55 degrees 45 minutes 09 seconds East a distance of 98.74 feet to a point; THENCE continuing along said right-of-way line North 79 degrees 00 minutes 55 seconds East a distance of 45.27 feet to a point, said point being the northwestern comer of Lot No. 28; THENCE along the western line of said lot South 22 degrees 32 minutes 22 seconds East a distance of 107.10 feet to a point, said point being on the northern right-of--way line of Longfellow Court; THENCE along said right-of-way line along a curve to the left having a radius of 50.00 and an arc length of 38.49 feet, said are being subtended by a chord of South 45 degrees 33 minutes 19 seconds West a distance of 37.55 feet to a point, the PLACE OF BEGINNING. CONTAINING 11,679.16 square feet or 0.2681 acres.
