JOE PASTUCCI individually and trading as ARCADE JOE 'CIVIL ACTION -LAW Defendant COMPLAINT The Plaintiff, ABF FREIGHT SYSTEM, INC., by its attorneys, KODAK 8~ IMBLUM, P.C., brings this action of Assumpsit against the Defendant to recover the sum of FIVE THOUSAND FIVE HUNDRED FIFTY-THREE DOLLARS AND FIFTY-EIGHT CENTS ($5,553.58), along with interest thereon at the statutory rate from September 28, 2006, upon a cause of action of which the following is a statement: 1 2 3 The Plaintiff, ABF FREIGHT SYSTEM, INC., is a corporation organized and existing under the laws of the State of Delaware, having its principal office and place of business at 3801 Old Greenwood Road, Fort Smith, AR 72903. The Defendant, JOE PASTUCCI, individually and trading as ARCADE JOE, is an adult individual residing at 265 Webster Street, Carlisle, Cumberland County, Pennsylvania 17013. On the dates, in the amounts, and for the prices set forth in the true and correct copies of Plaintiff's Invoices hereto attached, collectively marked Exhibit "A" and F:\USER\ROBIN\CCP&DJ CMPS\CCP COMPLAINTS\ABF FREIGHT SYSTEM\ABF FREIGHT SYSTEM.32796.wpd 2 made a part hereof, Plaintiff, at the special instance and oral request of the Defendant, performed labor and provided delivery services of the kind and description set forth on said Exhibit to the total amount of Four Thousand Two Hundred Seventy-One Dollars and Ninety-Nine Cents ($4,271.99). 4. The prices charged for said labor performed and services provided were just and reasonable, were the legal and market prices therefor and were the prices which the Defendant promised and agreed to pay to Plaintiff. 5. Due to Defendant's default in payment of said amount due and owing as aforesaid, interest/penalties have been added to said account in the total amount of One Thousand Two Hundred Eighty-One Dollars and Fifty-Nine Cents ($1,281.59), as shown on Plaintiffs Statement of Account attached hereto, marked Exhibit "B"and made a part hereof. 6. The balance due and owing by Defendant to Plaintiff is the sum of Five Thousand Five Hundred Fifty-Three Dollars and Fifty-Eight Cents ($5,553.58), as appears by Exhibit "B" hereto. 7. Plaintiff frequently demanded payment from Defendant of said amount due and owing as aforesaid, but Defendant refused and neglected and still refuses and neglects to pay said amount or any part thereof.
