Swope, husband and wife, of Pennsylvania, is about to execute contemporaneously herewith, a contract with Manning Homes, L.L.C. of Cumberland County, Pennsylvania, for the erection of a dwelling upon a lot of land situate as follows: ALL THAT CERTAIN tract or parcel of land and premises, situated, lying and being in the Borough of New Cumberland in the County of Cumberland and Commonwealth of Pennsylvania, more particularly described as follows: BEGINNING at a point along the southern right-of--way of Coolidge Street, said point being located North 76 degrees OS minutes 48 seconds West, a distance of 259.23 feet from a concrete monument set along the western right-of--way of Anna Street; thence from said point of beginning along lands now or formerly of Geneva C. Bruckart South 38 degrees 00 minutes 00 seconds East, a distance of 150.77 feet to a point; thence along Lot No. 7 and Lot No. 8 of Gates Manor South 53 degrees 27 minutes 00 seconds West, a distance of 70.99 feet to a point; thence along Lot No. 12 and Lot No. 14 of Gates Manor North 36 degrees 33 minutes 00 seconds West, a distance of 150.72 feet to a point along the southern right-of--way of Coolidge Street; thence along the southern right-of--way of Coolidge Street North 53 degrees 27 minutes 00 seconds East, a distance of 67.18 feet to a point, being the point of BEGINNING. BEING known as LotNo.15 ofthe Gates Manor Preliminary/Final Subdivision Plan, dated November 4, 1993, revised July 5, 1994, recorded in the Cumberland County Recorder of Deeds Office in Plan Book 68, Page 63. Also known and numbered as 406 Coolidge Street, New Cumberland, Pennsylvania. CONTAINING 10,412.85 square feet (0.24 acres). UNDER AND SUBJECT to several rights-of--way and easements as recorded in the Cumberland County Recorder of Deeds Office and further subject to the Gates Manor Preliminary/Final Subdivision Plan dated November 4, 1993, revised July 4, 1994 and recorded in the Cumberland County Recorder of Deeds Office in Plan Book 68, Page 63. ~-.. ~ • j NOW, the /©~ ~ day of April, 2007, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Charles M. Swope, III and Kimberly I. Swope, husband and wife to the said Manning Homes, L.L.C. to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Manning Homes, L.L.C. and the further consideration of One Dollar, to Manning Homes, L.L.C. paid by Charles M. Swope, III and Kimberly I. Swope, husband and wife it is agreed that no lien shall be filed against the building by the contractor, or any sub- contractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived.
