STIPULATION AGAINST LIENS
THIS AGREEMENT made thi s day of ~ r( /~~~(,;/~- 2 0 0 7 ,
between DANIEL Z. STEEL AND JANICE E. STEEL, of Mechanicsburg,
Pennsylvania, ("Owner"), AND CRAFTBUILT, INC., A Pennsylvania
Corporation(Contractor").
WHEREAS, The parties have entered into a written contract
("Contract") for improvements to be erected on the premises having
an address of:
Parcel 18 Smith Road, Gardners, Pennsylvania, South Middleton
Township, Cumberland County
("The Building").
NOW THIS AGREEMENT WITNESSETH: That the Contractor, in
consideration of the awarding to him by Owner of the Contract, as
well as the further consideration of One ($1.00) Dollar, the
receipt of which is hereby acknowledged, convenants, promises, and
agrees that no mechanics' lien or claim or other lien or claim of
any kind whatsoever shall be filed against the Building or the
curtilage appurtenant thereto, by Contractor, or by any
subcontractor, materialmen or laborers ("Others") for work done or
materials furnished under this Contract for and about the Building
or any part thereof, or on credit thereof, and that all Others
shall look to and hold Contractor personally liable for all
subcontracts, materials furnished and work and labor done, so that
there shall not be any legal or lawful claim of any kind whatever
against Owner for any work done or labor or materials furnished
under the Contract for the erection, construction and completion of
the Building, or under any contracts for extra work, or for work
supplemental thereto, or otherwise;
AND in order to give the Owner full power and authority to
protect himself and the lot of ground against any and all claims
filed by the Contractor or Others in violation of the foregoing
covenant, the Contractor for himself irrevocable authorizes and
empowers any attorney to appear for him in any Court of Common
Pleas as attorney for him and in his name, mark satisfied of record
at the cost and expense of the Contractor or Others, any and all
claims or liens, filed by or for the Contractor or Others against
the Building, lot of ground or any part thereof and for such acts
this shall be good and sufficient warrant and authority, and a
reference to the Court, Term and Number in which this Agreement
shall have been filed shall be a sufficient exhibit of the
authority herein to warrant such action, and the Contractor for
himself, does remise, release and quit-claim all rights and all
manner of errors, defects and imperfections whatsoever in entering
such satisfaction or in anywise touching or concerning the same.
