Hoffman d/b/a Hoffman's Custom Contracting hereinafter referred to as Contractor, and Susan Stiltner and Michael Stiltner, hereinafter referred to collectively as Owner. WHEREAS, the Contractor has undertaken and agreed to erect and construct a residence on Owner's real property known and numbered as ~-~' Minich Drive, DicKinson Township, Cumberland County, Pennsylvania, and as more particularly described on Exhibit "A" attached hereto and incorporated herein by this reference. NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and in consideration of the sum of One and 00/100 ($1.00) Dollar to it in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves and their subcontractors, and all parUes acting through or under them. covenant and agree that no mechanic's liens or claims thereto for or on account of any work done or materials furnished by them or any of them under said co?tract or otherwise, for, towards, in. or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and relinquish the right to have, file and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. WITNESS: WITNESS: "Contractor" Susan St[Itner "Owner" WITNESS: "Owner" EXHIBIT "A" DESCRIPTION OF REAL ESTATE ALL THAT CERTAIN piece or parcel of unimproved ground situate in Dickinson Township, Cumberland County, Pennsylvania, more particularly bounded and described in accordance with the Final Subdivision Plan of Green Hill, as recorded in the Office of the Recorder of Deeds in and for Cumberland County, in Plan Book 55, Page 17, as follows: BEGINNING at a point in the Northern right-of-way line of Minich Drive at the Southeastern corner of Lot No. 2 on the aforesaid Final Subdivision Plan; thence along said Lot No. 2, North 24 degrees 21 minutes 38 seconds West, 155.00 feet to a point; thence continuing along said Lot No. 2, North 27 degrees 04 minutes 46 seconds East, thence continuing along said Lot No. 2, North 27 degrees 04 minutes 46 seconds East, 211.19 feet to a point at the common corners of Lots Nos. 40 and 41 on the aforesaid Final Subdivision Plan; thence along said Lot No. 41 and Lot No. 42 on the aforesaid Final Subdivision Plan, South 46 degrees 45 minutes 53 seconds East, 300.00 feet to a concrete monument at the common corners of Lots Nos. 42 and 4 on the aforesaid Final Subdivision Plan; thence along said Lot No. 4, South 00 degrees 30 minutes 15 seconds West, 78.39 feet to a point in the Northern right-of-way line of said Minich Drive; thence along said Northern right-of-way line of Minich Ddve the following courses and distances, North 89 degrees 29 minutes 45 seconds West, 96.65 feet by a curve to the left with a radius of 228.71 feet, an arc length of 99.25 feet, and South 65 degrees 38 minutes 22 seconds West, 62.67 feet to a point in the said Northem right- of-way line of Minich Drive, the Place of BEGINNING. CONTAINING 58,558.66 square feet and being all of Lot No. 3 on the aforesaid Final Subdivision Plan. SUBJECT to the building and use restrictions recorded with the aforesaid Final Subdivision Plan and as modified and supplemented in Miscellaneous Book 349, Page 889, and to the building setback lines as set forth on the aforesaid Final Subdivision Plan. BEING the same property which Nelson L. Minich, married person, by his Deed dated August 16, 2002, and recorded in the in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Deed Book 253, Page 882, granted and conveyed unto Michael R. Stiltner and Susan R. Stiltner, husband and wife, Mortgagors herein.
