This instrument is executed this ~~~' day of April, 2007, by C.D.S. Construction
Co.("Contractor") in favor of William R. Webber and Lisa T. Webber("Owners")
Whereas, Owners are about to execute contemporaneously herewith, a contract with Contractor for
the erection of a house upon a lot of land situate in South Middleton Township, Cumberland County,
Pennsylvania, being known as Lot No. 4, the Final Subdivision Plan for Roy M. & Mary L. Leaman,
as recorded in Cumberland County Plan Book 91, Page 81, more fully described as follows:
BEGINNING at a concrete monument set on the eastern side of a Rural Residential Lane
at the southwest corner of Lot No. 3 as shown on the aforementioned Subdivision Plan; thence, along
the southern line of Lot No. 3 North 78 degrees 27 minutes 17 seconds East a distance of 279.27 feet
to an iron pin set on the western line of Lot No. 2A; thence, along the line of Lot No. 2A the
following two (2) courses and distances: (1) South 17 degrees 30 minutes 04 seconds East a distance
of 234.04 feet to a set iron pin; (2) thence, North 55 degrees 02 minutes 56 seconds East a distance
of 158.55 feet to an iron pin set at the southeast corner of Lot No. 2A as shown on the
aforementioned Final Subdivision Plan, and on the western line of lands now or formerly of Richard
L. and Nancy L. Kuhn; thence along lands now or formerly of Richard L. and Nancy L. Kuhn the
following four (4) courses and distances: (1) South 17 degrees 30 minutes 04 seconds East a
distance of 196.52 feet to a set iron pin; (2) thence, South 42 degrees 29 minutes 56 seconds West
a distance of 455.40 feet to a set iron pin; (3) thence, North 46 degrees 15 minutes 04 seconds West
a distance of 173.29 feet to an existing stone; (4) thence, South 62 degrees 14 minutes 56 seconds
West a distance of 439.82 feet to an iron pin set at the southeast corner of Lot No. 7A, as shown on
the aforementioned Final Subdivision Plan; thence along the eastern line of Lot No. 7A North 03
degrees 02 minutes 31 seconds West a distance of 71.54 feet to an iron pin set at the southwest
corner of Lot No. 5 as shown on the aforementioned Final Subdivision Plan; thence along the line
of Lot No. 5 the following three (3) courses and distances: (1) North 64 degrees O1 minutes 20
seconds East a distance of 65.04 feet to a set iron pin; (2) thence, North 49 degrees 10 minutes 28
seconds East a distance of 346.84 feet to a set concrete monument; (3) thence, North 30 degrees 36
minutes 48 seconds West a distance of 139.34 feet to an iron pin set on the southern edge of a Rural
Residential Lane; thence along said Rural Residential Lane the following three (3) courses and
distances: (1) on a curve to the left having a radius of 50.00 feet, an arc length of 103.21 feet, a
chord bearing of North 16 degrees 10 minutes OS seconds East and a chord length of 85.84 feet to

a set iron pin; (2) thence, on a curve to the right having a radius of 15.00 feet and an arc length of
13.62 feet, a chord bearing of North 16 degrees 57 minutes 23 seconds West and a chord length of
13.16 feet to a set iron pin; (3) thence, North 09 degrees 03 minutes 13 seconds East a distance of
144.83 feet to a set concrete monument the Place of BEGINNING.
Now, April 17, 2007, at the time of and immediately before the execution of the construction
contract aforesaid, and before any authority has been given by the said Owners to the said Contractor
to commence work on the said building, or purchase materials for the same, in consideration of the
Owners making of the said contract with Contractor, and intending to be legally bound hereby, it
is agreed that no lien shall be filed against the building by Contractor, or any sub-contractor, nor by
any of the materialmen or workmen or any other person for any labor, or materials purchased, or
extra labor or materials purchased for the erection of said building, the right to file such liens being
expressly waived.
