THE FOLLOWING NOTICE IS BEING PROVIDED PURSUANT TO THE FAIR DEBT
COLLECTION PRACTICES ACT, 15 U.S.C. 1601
The undersigned attorney is attempting to collect a debt owed to the Plaintiff, and any
information obtained will be used for that purpose. The amount of the debt is stated in this
Complaint. Plaintiff is the creditor to whom the debt is owed. Unless the Debtor, within thirty
(30) days after your receipt of this notice disputes the validity ofthe aforesaid debt or any
portion thereof owing to the Plaintiff, the undersigned attorney will assume that said debt is
valid. Ifthe Debtor notifies the undersigned attorney in writing with the said thirty (30) day
period that the aforesaid debt, or any portion thereof, is disputed, the undersigned attorney shall
obtain written verification of the said debt from the Plaintiff and mail same to Debtor. Upon
written request by Debtor to the undersigned attorney within said thirty (30) day period, the
undersigned attorney will provide debtor with the name and address of the original creditor if
different from the current creditor.

COMPLAINT IN MORTGAGE FORECLOSURE
1. Plaintiff, WASHINGTON MUTUAL BANK, FA, is a Corporation, with an address of P.O. BOX 1169,
DEPT. 2665 MILWAUKEE, WISCONSIN 53201.
2. Defendant, RICKY L. SCOTT, is an adult individual, whose last known address is 126 C STREET,
CARLISLE, PENNSYLVANIA 17013. Defendant, TRACEY L. SCOTT, is an adult individual, whose
last known address is 126 C STREET, CARLISLE, PENNSYLVANIA 17013.
3. On or about, March 5, 1999, the said Defendants, executed and delivered a Mortgage Note in the sum of
$70,950.00 payable to FOUNDATION FUNDING GROUP, INC. The Said Note is not accessible to
Plaintiff and is believed to have been lost. In further answer thereto, a copy is believed to be in the
possession of the Defendants.
Plaintiff also avers that the within Mortgage foreclosure complaint is based upon the Mortgage and that
the attachment ofa copy of the Note is unnecessary pursuant to Rules 1019(b) and 1141(a) of the
Pennsylvania Rules of Civil Procedure.
4. Contemporaneously with and at the time of the execution of the aforesaid Mortgage Note, in order to
secure payment of the same, Defendants, made, executed, and delivered to original Mortgagee, a certain
real estate Mortgage which is recorded in the Recorder of Deeds Office of the within County and
Commonwealth in Mortgage Book 1526, Page 1044 conveying to original Mortgagee the subject
premises. The Mortgage was subsequently assigned to WASHINGTON MUTUAL BANK, FA and will
be sent for recording. The Said Mortgage and Assignment are incorporated herein by reference.
5. The land subject to the Mortgage is: 126 C STREET CARLISLE, PENNSYLVANIA 17013.
6. The said Defendants are the real owners of the property.
7. The Mortgage is in default due to the fact that Mortgagors have failed to pay the installment due on May
01,2002 and all subsequent installments thereon, and the following amounts are due on the Mortgage:

The attorney's fees set forth above are in conformity with the Mortgage documents and
Pennsylvania law, and will be collected in the event of a third party purchaser at Sheriffs Sale. If the
Mortgage is reinstated prior to the sale, reasonable attorney's fees will be charged that are actually
incurred by Plaintiff.
8. No judgment has been entered upon said Mortgage in any jurisdiction.
9. Notice ofIntention to Foreclose and accelerate the loan balance pursuant to Pennsylvania Act No.6 of
1974 is not required in that the original principal balance exceeds $50,000.00.
10. Defendants are not members of the Armed Forces of the United States of America, nor engaged in any
way which would bring them within the Soldiers and Sailors Relief Act of 1940, as amended.
II. The within Mortgage is insured by the Federal Housing Administration under Title II of the National
Housing Act and, as such, is not subject to the provisions of Pennsylvania Act No. 91 of 1983.
WHEREFORE, Plaintiff demands judgment in mortgage foreclosure "IN REM" for the aforementioned
total amount due together with interest at the rate of 6.500% ($12.18 per diem), together with other charges and

AND NOW, comes Plaintiff, Washington Mutual Bank, FA and files the following Voluntary
Substitution and avers as follows:
1. Rule 2352 of the Pennsylvania Rules of Civil Procedure permits a substitution of a successor
by the filing of record, a statement of the material facts on which the rights of substitution are based.
2. Washington Mutuai Bank, FA, Successor by Merger to Bank United wishes to substitute itself
as the Plaintiff in the above-captioned action.
3. Materiai facts upon which the right of succession and substitution is based are as follows:
The original mortgagee was Foundation Funding Group, Inc. and the original
Mortgage was recorded on March 5, 1999 in Book 1526, Page 1044. The Mortgage was
assigned to Bank United and the Assignment was recorded on August 18, 1999 in Misc.
Book 622, Page 607. Bank United was party to a merger and the surviving corporation was
Washington Mutual Bank, FA.
4. Washington Mutual Bank, FA, Successor by Merger to Bank United does voiuntarily
substitute itself as Plaintiff in the above-captioned matter.

PLAINTIFF'S MOTION FOR SUMMARY JUDGMENT
AND NOW, comes the Plaintiff, Washington Mutual Bank, FA, Successor by Merger to Bank United,
by its attorneys, Purcell, Krug & Haller, and files the within Motion for Summary Judgment, and avers in
support thereof the following:
1. This action in mortgage foreclosure was originally instituted in the Court of Common Pleas
of Cumberland County by Complaint filed to No. 03-3620 on July 30, 2003.
2. Defendant, Ricky L. Scott filed an Answer to Plaintiffs Complaint on November 5, 2003.
3. In his Answer, the Defendant admitted or partially admitted Paragraphs 1 through 7, 8 and
10 of Plaintiff's Complaint.
4. The Defendant denied or partially denied Paragraphs 3,7,9 and 11 of Plaintiffs Complaint
which averred as follows:
3. On or about, March 5, 1999, the said Defendants, executed and delivered a
Mortgage Note in the sum of $70,950.00 payable to FOUNDATION FUNDING GROUP, INC.
The Said Note is not accessible to Plaintiff and is believed to have been lost. In further
answer thereto, a copy is believed to be in the possession of the Defendants. Plaintiff also
avers that the within Mortgage foreclosure complaint is based upon the Mortgage and that
the attachment of a copy of the Note is unnecessary pursuant to Rules 1 019(h) and 1141 (a)
of the Pennsylvania Rules of Civil Procedure.
7. The Mortgage is in default due to the fact that Mortgagors have failed to pay the
installment due on May 01, 2002 and all subsequent installments thereon, and the following
amounts are due on the Mortgage:

--Together with interest at the per diem rate noted above after August 1, 2003 and other
charges and costs to date of Sheriff's Sale.
The attorney's fees set forth above are in conformity with the Mortgage documents and
Pennsylvania law, and will be collected in the event of a third party purchaser at Sheriff's
Sale. If the Mortgage is reinstated prior to the saie, reasonabie attorney's fees wiil be charged
that are actually incurred by Plaintiff.
9. Notice of Intention to Foreclose and accelerate the loan balance pursuant to
Pennsylvania Act NO.6 of 1974 is not required in that the principal balance exceeds
$50,000.00.
11. The within Mortgage is insured by the Federal Housing Administration under Title II
of the National Housing Act and, as such, is not subject to the provisions of Pennsylvania Act
No. 91 of 1983.
5. The Defendant's Answer to Paragraphs 3, 7, 9 and 11 reads as follows:
3. It is admitted that a note was signed however, Defendant was without information as
to the exact contents of the note and proof of the contests is specifically demanded at trial.
7. Denied and strict proof of the same is demanded at trial. By way of further answer,
what is due on the mortgage would depend upon the contents of the note afore-referenced.
9. A conclusion of law and requires no answer.
11. A conclusion of iaw and requires no answer.
6. In Paragraph 3 of its Complaint, the Plaintiff averred the Defendants' execution of the
Mortgage Note on March 5, 1999 for $70,950.00, payabie to original mortgagee, Foundation Funding Group,
Inc., but could not attach a copy of the document since it could not be located.
7. In his Answer to Paragraph 3, the Defendant admitted signing a Note, but could not respond
to the contents of the Note since it was not attached.
8. The issue is now moot in that the Piaintiff has located the Note and has attached a copy to
its Summary Judgment Affidavit fiied concurrently with its Motion for Summary Judgment.
9. Rule 1029 of the Pennsylvania Rules of Civil Procedure governs the proper procedure for a
party to respond to a pieading. Rule 1029 reads in pertinent part:

a) A responsive pleading shall admit or deny each averment of fact in the preceding
pieading or any part thereof to which it is responsive. A party denying oniy a part of
an averment shall specify so much of it as is admitted and shall deny the remainder.
Admissions and denials in a responsive pleading shall refer specifically to the
paragraph in which the averment adm itted or denied is set forth.
b) Averments in a pleading to which a responsive pieading is required are admitted
when not denied specifically or by necessary impiication. A general denial or a
demand for proof, except as provided by subdivisions (c) and (e) of this ruie, shall
have the effect of an admission.
c) A statement by a party that after reasonable investigation the party is without
knowledge or information sufficient to form a belief as to the truth of an averment
shall have the effect of a denial.
10. In response to Paragraph 7, the Defendant generally denied the fact and amount of default,
making no averment of "after reasonable investigation".
11. In its Summary Judgment Affidavit, the Plaintiff verifies that both Defendants are in default
and includes in its Affidavit the amounts necessary to both reinstate and payoff the account.
12. The Plaintiff also attaches to its Summary Judgment Affidavit a true and correct copy of the
Payment History for the Defendants' account from January 4, 2000 through November 26, 2003 as
documentary proof of the date of default of May 1, 2002, principal balance of $68,407.75 and that the last
payment credited to the account was on June 3, 2002 for the payment due Aprii 1, 2002.
13. In Paragraphs 9 and 11, the Defendant denied as conclusions of law Plaintiff's averments
regarding its compliance with the Notice provisions of Act 6 of 1974 and Act 91 of 1983.
14. Since the Defendants' original Mortgage obligation was greater than $50,000.00, the Plaintiff
had no statutory obligation to send Act 6 Notices to either of the Defendants.
15. As to Act 91 Notices, pursuant to 35 P.S. S1680.401 (c)(a)(4), the Plaintiff was also not
required to send Act 91 Notices because the Mortgage is insured by the Federal Housing Administration and
the provisions of Act 91 are not appiicable.
16. However, in order to comply with the pre-foreclosure Notice requirements of the Mortgage,
the Plaintiff did send Notices to both Defendants dated June 13, 2003, addressed to the property address,
which was their last known mailing address at the time.
17. Upon Affidavit filed concurrently with this Motion, the status of the mortgage payments made
to and received by Plaintiff is verified and reveals that both Defendants are in default under the terms of the

Mortgage and that no cure has been effected.
18. The Affidavit further indicates that Plaintiff is the owner and holder of the Mortgage Note
dated March 5,1999 executed by both Defendants in the amount of $70,950.00 for real estate situated at 126
C Street, Carlisle, Pennsylvania 17013, for which both Defendants are the record owners.
19. By reason of the Defendant's foregoing admissions and the documentation of defauit without
an aiiegation that the default has been cured or documentation thereof, there is no longer a triable issue of
fact or law.
20. There being no defense to Plaintiff's Complaint, judgment should be entered in favor of
Plaintiff and against the Defendant, Ricky L. Scott.
WHEREFORE, Plaintiff requests this Honorable Court to enter an Order granting Plaintiff's Motion
for Summary Judgment against the Defendant, Ricky L. Scott and to enter an in rem judgment in favor of the
Plaintiff.

L. SCott and Tracy L. Scott, which was recorded on March 5, 199910 the Cunibeiland County Recorder's Office in
ElO0l<1526, Page 1044. The Mortgage was assigned to Bank United and the Assignment was recorded on August

Borrower and Ltnder covenant and agree as follows:
UNIFORM COVENANTS.
1. l'ayment of Principal, Interest and Late Chllrge. Borrower shall p:lY when due the principal of. and
interest on, the debt evidenced by the Note and late charges due under lhe Now.
2. Monthly Payment of Taxes, Insurance, llnd Olher Charges, Borrower shall include in each monthly
payment, together with the principal and interest assel fOrlhinlheN oteand any late charges, asumfor(a) taxes
and special assessments levied or to be levied againsllhe Propeny, (b) leasehold payments or ground rtnts on lhe
Property, and (c) premiums for insurance required under Paragraph 4. In any year in which the Lender must pay
a morlgage insurance premium lO the Secrtlary of Hausing and Urban Development ("Secrelary"), or in any year
in which such premium would have been required if Lender slill held the S.:curity Instrument, each monlhly
payment shall also include either: (i) a sum for the annual mongage insurance pr,~mium to be paid by lender 10 lhe
Secretary, or (iil a monthly charge inslead of a mongage insurance premium if Ihis Security Instrument is held by
lhe Secretary, in a reasonable amount to be detennined by the Secretary. Exc':pt for Ihe monthly charge by the
Secretary, these items are called "Escrow items" and the sums paid to Lender iLre called "Escrow Funds."
Lender may, at any time, collect and hold amounlS for Escrow hems in an aggregate amounl not to exceed the
maximum amount that may be required for Borrower's escrow account under the Real Estate Selllement Procedures
Act of 1974, 12 U.S.C. ~2601 f!:f.!!l. and implementing regulations, 24 CFR Part 3500, as they may be amended

If the amounts held by Lender for Escrow Items exceed the amounts pennilted to be held by RESPA, Lender

to make up the shonage as permiued by RESPA
The Escrow Funds are pledged as additional stcurity for all sums secured by this Security Inslrument. If

J. Application of Payments, All payments under Paragraphs 1 and 2 shall be applied by Lender as follows:

Second, to any laxes, spedal assessments, ieasehold payments or ground rems, and tire, flood and olher hazard

4, Fire, Flood and Other Hazard Insurance. Borrower shall insure all improvements on the proptrty,
whether now In existence or subsequentlyerecled, against any hazards, casualties, and contingencies, including fire,
for which Lender requires insurance. This insurance shall be maintained in the, amounts and for the periods that
Lender requires. Borrower shall also insure all improvements on the Propel1y, whether now in existence or
subsequenllyerecled, against loss by floods to the e,uent required by the Secretary. All insurance shall be carried
Wilh companies approved by Lender. TIle insurance policies and any renewals shall be held by Lender and shall
indude lnss payable clauses in favor of, and in a fonn acceptable to, Lender.
In the event of Joss, Bortower shall give Lender immediate notice by mail, Lender may make proof of loss
if not made promptly by Borrower. Each insurance company concerned is hereby aUlhorized and directed 10 make
payment for such Joss direclly to Lender, instead of to Borrower and to Lend,:r jointly. All or any part of the
insurance proceeds may be applied by Lender, at its option, either (a) 10 the reduction of the indebtedness under
lhe Note and this Security Instrument, first to any delinquent amounlS applied in the order in Paragraph 3, and lben
to prepayment of principal, or (b) to the restoration or repair of the damaged propeny. Any application of the
proceeds to the principal shall not extend or postpone the due dale of the monthly payments which are referred to
in Paragraph 2, or change the amount of such payments. Any excess insurance proceeds over an amount required

extenuating circumstances. Borrower shall not commit waste or destroy. damage Of substantially change the

to the Propeny, the leasehold and fee title shall not be merged unless Lender agrees to the merger in writing.
6. Condemnation, The proceeds of any award or claim for damages, direct Ot' consequential, in connection
with any condemnation or other taking of any pan of the Property, or for conveyance in place of condemnation,
are hereby assigned and shall be paid to Lender to [he extent of [he full amount of lhe indebtedness that remains
unpaid under the Note and this Security Instrument. Lender shall apply such pro=eeds to the reduction of the

olher covenants and agreements contained in this Security InstJ'\nnent, or there J!; a legal proceeding that may
significantly affetl Lender's rights in the Property (such as a proceeding in bankmptcy, for condemnation or to
enforee laws or regulationS), then Lender may do and pay whatever is necessary to p::otect the value of the Property
and Lender's rights in the Property, including paymenl of taxes, hazard insurance and other items menlioned in
Paragraph 2.
Any amounts disbursed by Lemler under this Paragraph shall become an additional debt of Borrower and be
secured by this Security Instrument. TI1C&e amounts shall be~r interest from the dale of disbursement, at the Note
rate, and lit the optionof,Lender, shall be immediately due and payable.
Borrower shall promptly discharge any lien which has priority o\'er Ihis Security Instrument unless Borrower:
(a) allrees in writing to the payment of tlie obligation secured by the lien in a manner acceptable to Lender; (b)
contests in good faith the lien by, or defends against enforcement of the lien in, lellal proceedings which In the
Lender's opinion operate to prevent the enforcement of the lien; or (c) secures from the holder of the lien an
agreement satisfactory to Lender subordinating the lien 10 this Security Instrument. If Lender detennines that any
part of the Propeny is subject to a lien which may attain priority over this Securitl' Instrument, Lender may give
Borrower a notice identifying the !len. Borrower shall satisfy the lien or take one I)r more of the actions set forth

9. Grounds for Acceleration ofOebt.
(a) Default. Lender may, except liS limited by regulations issued by the ~:ecretary in the case of payment
defaults, require immediate payment in full of all sums sc<:ured by this St~curity Instrument if:
(1) Borrower defaults by failing to pay in full any monthly payment required by this Security
Instrument prior to oron the due date of the next monthly payment, or
(iil Borrower defaults by failing, for a period of thirty days, !O perform any olher obligations contsined
in this Security Instrument.
(b) Sale Without Credlt Approval. Lender shall, ifpennitted by applicable law (including section 341{d)
of the Garn-St Gennain Depository InstitUllons Act of 1982, 12 U.S.C. 170Ij-3(d)) and with the prior
IIpproval of the Secretary. require immediate payment in full of all sums secured by this Security
Instrument if:
(i) All or part of the Property, or a beneficial interest in a trust owning all or part of the Property,
is sold or otherwise transferred (other than by devise ordescenl), an,1
(ii) The Property IS not occupied by the purchaser or grantee as his or her principal residence, or the
purchaser or Ilrantee does so occupy the Property but his or her cred it has Ilotbeen approved in
accordance with lhe requiremenlS oflheSecretary. .
(c) No Waiver. If circumstances occur that would pennit Lender to require immediate payment in full,
but Lender does not require such payments. Lender does not waive its rights with respect to subsequelH
events.
(d) Regulations or IIUO Secretary. In ma.ny circumstances regulations issued by the Secretary will limit
Lender's rights, in the case of payment defaults to require immediate payment in full and foreclose if not

determined to be eligible for insurance under the National Housing Act within SIXTY (60) DAYS
from the dale hereof, Lender may, at its option require irrunediate payment in full of all sums secured by

10. Reinstatement. Borrower has a right to be reiostated if Lender has n:quired immediate payment in full

even after foreclosure proceedings are instituted. To reinstate the Security Instrument. Borrower shall lender in a
lump sum all amounts required to bring Borrower's accounl curren! including, to the extent they are Obligations of
Borrower under this Security Instrument, foreclosure costs and reasonable and customary attorney's fees and
expenses properly associated with the foreclosure proceeding. Upon reinstatl:ment by Borrower, this Security
Instrument and the obligations that it secures shall remain in effect as if Lender hnd nOI required immediate payment
in full. However, Lender is not required to permit reinstatement if: 0) Lender has accepted reinstatement afler Ihe
commencement of foreclosure proceedings within twO years immc:diately preceding the commencement of a current

11. Borrower Not Relellsed; Forbearance Dy Lender Not a Waiver, Extension of the lime of payment or
modit1cation of amortization of the sums secured by this Security Instrument granted by Lender to any successor
in interest of Borrower shall not operate to release the iiability of the original Borrower or Borrower's successor
in interest. Lender shall not be required to commence proceedings against an:, successor inintereSI or refuse to
extend lime for payment or otherwise modify amonization of the sums secured by this Security Instrument by reason
of any demand made by the original Borrower or Borrower's successors in int,:resl. Any forbearance by Lender
in exercising any right or remedy shall not be a waiver of or prec1ude the exer;ise of any right or remedy.
12. Successors and Assigns Dound; Joint and Several Liability; Co.Sign,~rs. The covenanls and agreements
of this Security Instrument shall bind and benefillhe successors and assigns of Lender and Borrower, subjecl to the
provisions of Paragraph 9(b). Borrower's covenants and agreements shall bejoim and several. Any Borrower who
co-signs this Security Instrument but does not execute the Note: (a) is co-signing this Security Instrument only 10
mortgage, grant and convey that Borrower's interest in the Property under the temu of this Securily Instrument;
(b) is not personally ohligated to pay the sums secured by this Security Instrument; and (c) agrees that under and
any other Borrower may agree to extend, modify, forbear or make any accorrunodations with regard 10 the lenns
of Ihis Security Inslrument or the Nole without thai Borrower's consent.
13. Notices. Any nOlice 10 Borrower provided for in this Security Instrument shall be given by delivering it
or hy mailing it by first class mall unless applicable law requires use of another method. The notice sball be
directed to the Propeny Address or any other address Borrower designates by notice to Lender. Any notice to
Lender shall be given by first class mail to Lender's address Slated herein or any address Lender designates by
notice to Borrower. Any notice provided for in this Security Instrument shall be deemed to have been given to
Borrower or Lender when given as provided in this Paragraph.
14. Governing Law; SevenlbiJHy, This Security Instrument shall be gc,verned by Federal law and the law
of the jurisdiction in which Ihe Property is located. [n the event that any provision or clause of this Security
Instrument or the Note conflicts with applicable law, such conflict shall not affect other provisions of this Security
Inslrument or the Note which can be given effect without the confiicting provision. To this end the provisions of
tltisSecurity Instrument and'lhe Note are declared lObe severable.
15. Borrower's Copy. Borrower shall be given one confotmed cop~' of the Note and of this Security
Instrument.
16. Hazardous Substances, Borrower shall not cause or permit the presence, use, disposal, storage, or
release of any Hazardous Substances on or in the Propeny. Borrower shall r,ot do, llor allow anyone else to do,
anything affecting Ihe Property that is in violation of any Environmental Law. The preceding two sentences shall
not apply to lhe presence, use, or storage on thc Propeny of small quantltks of Hazardous Substances that are
generally recognized to be appropriate 10 normal residential uses and to maimenance of the Property.
Borrower shall prompUy give Lender written notice of any investigation, claim, demand, lawsuit or other action
by any governmental or regulatory agency or private party involving the Propf~ny and any Hazardous Substance or
Environmental Law of which Borrower has aClual knowledge. If Borrower learns, or is notified by any
governmental or regulatory authority, that any removal or other remedial Ion of any Hazardous Substances affecting
the Property is necessary, Borrower shall promptly take all necessary remedial actions in accordance with
Environmental Law.
As used in this Paragraph 16, 'Hazardous Substances" are Ihose substances defmed as toxic or hazardous
substances by Environmental Law and the following substances: gasoline, k.erosene, other llammable or loxic
petroleum products, toxic pesticides and herbicides, volatile solvents, materials containing ashestos or formaldehyde,
and radioactive materials. As used in this Paragraph 16, "Environmental Law" means federal laws and laws of the

NON-UNIFORM COVENANTS. Borrower and Lender further covenant and ;lgree as follows:
17. Assignment of Rents. Borrower unconditionally assigns and transfers to Lender all the rents and revenues
of the Property. Borrower authorizes Lender or Lender's agents to collect the rents and revenues and hereby directs
each tenant of the Property to pay the rents to Lender or Lender's agent. Howevf~r, prior to Lender's notice to
Borrower of Borrower's breach of any co~enant or agreement in the Security Instrument, Borrower shall collect
and receive all rents and revenues of the Property as trustee for the benefit of Lender and Borrower. This
assignment of rents constitutes an absolute assignment and nOl an assig nment for additional securllY only.
If Lender gives notice of brt:ach to Borrower: (8) all rents received by Borrower shall be held by Borrower
as trustee for benefit of Lender only, to be applied 10 the sums secured by the Security Instrument; (b) Lender shall
be entitled to oollect and receive all of the rents oflhe Property; and (c) each tenlW,t of the Property shall pay all
rents due and unpaid to Lender or Lender'~ agent on Lender's written demand to the tenant.
Borrower has not executed any prior assignment of the rents and has not and will not perfonn any aCI that
would prevent Lender from exercising its rights under this Paragraph 17.
Lender shall not be required to enter upon, take control of or maintain the Property before or after giving notice
of breach to Borrower. However, Lender or ajudicially appointed receiver may do so at any time there Is a breach.
Any application of rents shall nOl cure or waive any default or invalidate any other ril~ht or remedy of Lender. This
assignment of rents of the Property shalltenninate when the debt secured by the Security Instrument is paid in full.
18. Foreclosure Procedure. If Lender requires immedlale payment In full under Paragraph 9, Lender
may foreclose this Security Instrument by Judicial proceeding, Lender shall be I~ntltled to collect all expenses
Incurred in pursuing the remedies provided in this paragraph 18, Including, but not limited to, altorneys' fefS
and costs oftllle evidence.
If Ihe Lender's interest in this Security Instrument Is held by the Secretary and the Secretary requires
Immcdiate payment In full under Paragraph 9, the Secrelary may Invoke the nonjudicial power of sale
provided in the Single Fumlly Mortgage Foreclosure Act of 1994 ("Act") 112 V.S.C. 37S1 !J mI,) by
requesting a foreclosure commissioner deslanaled under the Act to commence foreclosure and to seJl the
Property as provided in the Act, Nothing In the preceding sentence shall deprive the Secretary of any rights

19. Release. Upon payment of all sums secured by this Security Instrument, this Security Instrument and the
estate conveyed shalltermlnale and become void. After such occurrence, Lender shall discharge and satisfy this
Securily Instrument withOlll charge to Borrower. Borrower shall pay any recordation costs.
20, Waivers. Borrower, to the extent penniued by applicable law, waives and releases any error or defects
in proceedings to enforce this Secllrity Instrument, and hereby waives the benefit of any present or future laws
providing for stay of execution, extension of time, exemption from attachment, levy and sale, and homestead
exemption.
21. Reinstatement Period, Borrower's time to reinstate provided in paragrai>h 10 shall extend to one hour
prior to the commencement of bidding at a sheriff's sale or other sale pursuant to this Security Instrument.
22, Purchase Money Mortgage. If any of the debt secured by this Security Instrument is lent to Borrower
to acquire title to the Property, this Security Instrument shall be a purchase money mortgage.
23. Interest Rail' After Judgment. Borrower agrees that the interest rate payable after a judgment is entered
on the Note or in an action of mortgage foreclosure shall be the rate payable from lime to time under the Note.

Sunday Patriot-News newspapers of general circulation, printed and published at 812 to 818 Market Street, 'n the
City, County and State aforesaid; that The Patriot-News and The Sunday Patriot-News were established Ma ch 4th,
1854, and September 18th, 1949, respectively, and all have been continuously published ever since;
