COMPLAINT
AND NOW comes Plaintiff and avers as follows:
1. Plaintiff is Romeo Lio, a an adult individual with a home and business address
of 3224 Market Street, Camp Hill, Cumberland County, Pennsylvania 17o11.
2. Defendant is Terry Brossman, DBA Brossman Sealcoating, is an adult
individual with a mailing address of 822 Orchard Road, Manheim, PA 17545.
3. Defendant Kazi Foods, DBA "Kentucky Fried Chicken", is a corporation
conducting business at 20 North 32nd Street, in the Borough of Camp Hill, Cumberland
County, Pennsylvania.
4. Plaintiff Lio's property is located directly adjacent to Defendant Kazi's
"Ketucky Fried Chicken" restaurant/property.
5. Plaintiff Lio is the owner of a 2004 Blue Chevrolet Cavalier, which Plaintiff
Lio parked directly adjacent to Defendant Kazi's Kentucky Fried Chicken on July 18,20o6.
6. Defendant Kazi hired Defendant Brossman to clean and seal coat their
parking lot directly adjacent to Plaintiff Lio's property to include the area where Plaintiff
Lio parked his automobile, on or about July 18,20o6.
7. Defendant Kazi and Defendant Brossman failed to provide notice and/or to
forewarn Plaintiff Lio that their parking lot was going to receive cleaning and seal coating
on or about July 18, 2oo6 in order to allow Plaintiff Lio the opportunity to move his vehicle.
8. During the cleaning and application of seal coating on July 18, 2oo6, by
Defendant Brossman to Defendant Kazi's parking lot reasonable measures were not
implemented to ensure debris would not be blown upon neighboring Plaintiff Lio's property
to include Plaintiff Lio's automobile.
9. During the cleaning and application of seal coating on July 18, 2oo6, by
Defendant Brossman while under the hire of Defendant Kozi, significant debris to include
rocks were recklessly and negligently blown onto Plaintiff Lio's property to include his 2004
Blue Chevrolet Cavalier causing significant damage to both (see attached Exhibit "A").
10. As a result of Defendants' careless actions on July 18, 2oo6, Plaintiff Lio
sustain significant damage to his 2004 Blue Chevrolet Cavalier which total $1,119.04 (see
attached Exhibit "B").
11. As a result of Defendants' careless actions on July 18, 2006, Plaintiff Lio,
sustained significant damage to his building which total $500.00.
12. Plaintiff Lio on July 18, 2oo6 contacted the Camp Hill Police, and Officer Warren
Cornelious, badge number 178, responded and prepared a police report (see attached
Exhibit "C") documenting the debris on Plaintiff Lio's property.
13. Plaintiff Lio filed an action before the Honorable District Justice Manlove,
Magisterial District # 09-1-02 and a hearing was conducted on March 27, 2007, to which a
Judgment was ordered in favor of the Plaintiff in the amount of $2,239.12.
WHEREFORE, Plaintiff requests this Honorable Court to enter judgment against
Defendants in the amount of $1,619.0o with reasonable attorney's fees and such other costs
as this Court may deem proper.
