THIS AGREEMENT made this ~ day of ~VU~ , 2003,
between FARINELLI CONSTRUCTION, INC., hereinafter referred
Contractor,
by and
to as
JEANNE K. FARINELLI, hereinafter referred to as Owners, whereby the
contractor undertook and agreed to erected and construct a dwelling
on the certain lot of ground situate in Upper Allen Township,
Cumberland County, Commonwealth of Pennsylvania, and more fully
described in Exhibit "A" which is attached hereto and made a part
hereof known as Lot #5, Mechanicsburg, PA 17055.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

Exhibit A
ALL THAT CERTAIN tract or parcel of land situate in the Township of Upper
Allen, County of Cumberland, Commonwealth of Pennsylvania more particularly
bounded and described as follows to wit:
BEGINNING at a point on the southwestern right of way line of Kacey Court at the
dividing line between lots No. 4 and 5 as shown on the hereinafter mentioned plan;
thence along the dividing line between lots No. 4 and 5 South 51° 58'0' West a
distance of 277.15' feet to a point on the northeastern line of lands now or formerly
of~Stanley F. Werzyn; thence along the northeastern line of said lands of Stanley F.
Werzyn North 23005'53" West a distance of 210.00' feet to a point at the dividing
line between lots No. 5 and 6; thence along the dividing line between lots No. 5 and 6
North 64°10'55" East a distance of 203.78' feet to a point on the western right of
way line of Kacey Court cul-de-sac by a curve, curving the left having a radius of
50~00' feet and an arc length of 56.06' feet to a point; thence by a curve, curving to
the right having a radius of 15.00' feet and an arc length of 13.62' feet to a point on
the southwestern right of way line of Kacey Court; thence along the southwestern
right of way line of Kacey Court South 38002'00" East a distance of 97.97' feet to a
point, said point being the place of BEGINNING.
BEING Lot No. 5 as shown on the Final Subdivision Plan of Chad Hazam. Said
Plan being recorded in the Office of the Recorder of Deeds, Cumberland County,
Commonwealth of Pennsylvania in Plan Book 60, Page 4.
