[72 PS. 39116 (a) (1.1) (i)].
For dates of death on or after January 1, 1995, the tax rate imposed on the net value of transfers to or for the use of the surviving spouse is 0% [72 P.S. S9116 (a) (1.1) (ii)l.
The statute does not exempt a transfer to a surviving spouse from tax, and the statutory requirements for disclosure of assets and filing a tax return are still applicable even if
the surviving spouse is the only beneficiary.
For dates of death on or after July 1, 2000:
The tax rate Imposed on the net value of transfers from a deceased child twenty-one years of age or younger at death to or for the use of a natural parent, an adoptive parent.
or a stepparent of the child is 0% [72 P.S. ~9116(a)(1.2)].
The tax rate imposed on the net value of transfers to or for the use of the decedent's lineal beneficiaries is 4.5%, except as noted in 72 P.S. ~9116(1.2) [72 PS. 39116(a)( 1)j
The tax rate Imposed on the net value of transfers to or for the use of the decedent's siblings is 12% [72 P.S. s9116(a)(1.3)]. A sibling is defined. under Section 9102. as an
individual who has at least one parent in common with the decedent. whether by blood or adoption.

personal, and wheresoever situate, to my wife, EDNA MAE RIGLING,
providing that she survives me by thirty (30) days.

D. 10% to my step-grandson, DONALD T. GRAY, JR., the son of
my late son's wife, JUDY, by her present marriage, if he is living on
the thirty-first (31st) day upon my death, and if he is not then
living his share shall lapse and be divested and be added to the other
shares created in this will.
ITEM III: I appoint my Executrix and her successors guardian of
the estate of any property which passes either under this will or
otherwise, to a minor and with respect to which I am authorized to
appoint a guardian and have not otherwise specifically done so,
provided that this appointment of a guardian shall not supersede the
right of any fiduciary in its discretion to distribute a share where
possible to the minor or to another for the minor's benefit. Such
guardian shall have the power to use principal as well as income from

education, both graduate and undergraduate) without regard to his or
her parent's ability to provide for such support and education, or to
make payment for these purposes, without further responsibility, to

ITEM IV: I appoint my wife, EDNA MAE RIGLING, Executrix of this
my last will. If she fails to qualify or ceases to act for any
reason, I appoint my grandsons, THOMAS G. RIGLING, III, and EDWARD
MARK RIGLING, as Co-Executors in her place with the same powers and
duties.
ITEM V: No fiduciary acting hereunder shall be required to post
bond or enter security in any jurisdiction.

homestead real property situate at 620 Third Street, New Cumberland, Cumberlan
County, Pennsylvania in the decedent's daughter, Lucinda E. Rig1ing, with the
remainder interest being vested in Lucinda E. Rig1ing and the decedent's son,
Thomas George Rigling, or his issue. Your accountants propose to the court th t
the title to this real property was vested at the time of the death of the dec -
dent, Nellie S. Rigling, in Lucinda E. Rigling and Thomas George Rigl1ng, by
virtue of the will of the decedent's late husband, George Bower Rigling, who
died January 11, 1971. See proceedings in Cumberland County Estate No.
21-75-695. The said George Bower Rigling owned the said real property in fee
simple and in his will, he devised it for life to his widow, Nellie S. Rig1ing,
the decedent herein, with the remainder being vested in his children, Lucinda

Road to the east, Yellow Breeches Creek to the south, and Interstate Route 83 to the west.

Neighboring shops, parks, schools and most services are within a 10 minute drive.The area is a mix of mostly single family
detached and attached homes located in the West Shore School District, which consists of Northern York County including
Newberry Township and southern Cumberland County municipalities of Lower and Upper Allen Township, and New
Cumberland.
Neighborhood Market Conditions
Consistent with other neighborhoods in this area, homes in the subject neighborhood have experiencecl moderate
appreciation in recent years. Conventional, FHA, and VA financing are readily available. with occasional sales concessions.
Interest rates remain favorable, and have recently declined. Based on the average condition of the subject property, a
marketing period of less than six months is projected for the property assuming a marketing price not in excess of 20% of
the opinion of value concluded in this report and competent brokerage.
