Dear Ms. Strasbaugh:
This is in furtherance of my discussion with your office staff on April 12,
2007, regarding the issuance of Letters of Administration to Kim D. Rukas, the ex~
wife of the Decedent, Mark S. Rukas ("Decedent"), who died in testate on April 2.
2007. Kim Rukas is the parent and natural guardian of Sydney R. Rukas, the
minor child of the Decedent, who is the Decedent's sole heir. 'offer the following
background facts by way of explanation as to why letters are being sought by Kim
Rukas.
In the early morning hours of Saturday, March 31, 2007, the Decedent,
while a pedestrian, was struck by a motor vehicle in Hummelstown. Dauphin
County. Pennsylvania. The Decedent sustained grievous head injuries and was
transported to Hershey Medical Center where he succumbed to his injuries on
Monday. April 2. 2007. At the time of his death, the Decedent resided at 6206
Stanford Court, Mechanicsburg, PA 17050. The Decedent was not married at the
time of his death and his sole heir is his minor daughter, Sydney, again, who
resides with Kim Rukas. It is believed that the Decedent's estate is currently
insolvent. Potentially, however. there may be claims against several tortfeasors,
although the facts regarding this are sketchy at this time. In any event, the
purpose of opening the Estate was for purposes of litigation to determine whether
there could be a recovery for the Estate, the proceeds of which would be utili~ed
to pay any outstanding debts with the remainder going, by intestate succession,
to the minor child.
AS the Decedent was not married at the time of his death, the appropriate
person to apply for and be granted Letters of Administration would be his mother,
Audrey J. Rukas ("Mrs. Rukas"), who is a resident of Twenty Nine Palms,
California. Decedent's father is also deceased. At the time the documents were

completed in your office on April 12, 2007, Mrs. Rukasexecuted a Renunciation form. In her Renunciation,
she requested that Kim Rukas be appointed Administratrix and. therefore. be issued Letters of
Administration.
The Decedent did. however. have siblings and the question then becomes whether each of these
five siblings would also have to complete a Renunciation form. It is my understanding it is within your
sound discretion to grant Letters of Administration to Kim Rukas without the necessity of obtaining
Renunciations from five siblings. four of whom do not live in Pennsylvania. For your edification. however,
the five siblings names and their city and state of residence are as follows:
1. Steven Rukas,
Desert Hot Springs. CA;
2. Mathew Rukas,
Las Vegas. NV;
3. Lawrence Rukas.
Cottonwood. AZ.:
4. Debra Rukas.
Twenty Nine Palms. CA: and
5. Victoria Avaritt.
Enola. PA.
On behalf of Mrs. Rukas and Kim Rukas, the mother of the sole heir of Decedent's estate. I would
request that you employ your discretion in granting the Petition of Kim D. Rukas and grant her Letters of
Administration for the Estate of Mark S. Rukas. Deceased.
