PETITION TO OBTAIN TITLE TO VEHICLE NOW COMES, Capitol Limousine Service, Inc. ("Capitol"), by and through its counsel, Rhoads & Sinon LLP, and files the within Petition to Obtain Title to Vehicle and in support thereof, avers as follows: 1. On or about September 15, 2006, Capitol purchased a 2002 Cadillac Escalade SUV Limousine with 87,000 miles from Leo Yakoviev of 1000 Sunrise Avenue, Suite 9B, Roseville, CA 95661. The vehicle VIN # is 1GYEK63N92R157447 ("the vehicle"). 2. The transaction was recorded on a Bill of Sale. A copy of the Bill of Sale is attached as Exhibit "A." 3. As evidenced by the Bill of Sale, Mr. Yakoviev represented that he had free and clear title to the vehicle that was being mailed to his office. The Bill of Sale was notarized by a notary in Placer County, California. See Exhibit "A." 4. On or about September 14, 2007, Thomas Brown of Capitol traveled to Sacramento, California to complete the transaction and obtain title to and possession of the vehicle. See Affidavit of Thomas Brown attached as Exhibit "B." 649590. ] 5. On September 15, 2006, Mr. Brown, Mr. Yakoviev and Mr. Yakoviev's friend Russ went to a satellite Department of Motor Vehicles office in Roseville, California to inquire about the title to the vehicle. See Exhibit "B." 6. The DMV representative told Mr. Brown that Mr. Yakoviev had completed the paper work to have the title issued to him in California. The DMV representative showed Mr. Brown the computer screen demonstrating that this had taken place. The DMV representative further represented to Mr. Brown that there were no liens on the vehicle and title was clear. See Exhibit "B." 7. Mr. Yakoviev further represented on the Bill of Sale that Capitol could operate the vehicle under Mr. Yakoviev's registration, insurance and plate until he could send the title, free and clear, by certified mail. See Exhibit "A." 8. Since September 2006, Capitol has made a good faith effort to locate Mr. Yakoviev in order to obtain title to the vehicle. Several representatives of Capitol have tried to call Mr. Yakoviev numerous times. Mr Yakoviev has not responded to any phone calls. 9. Capitol also tried to reach Mr. Yakoviev at the place of business which Mr. Yakoviev apparently used to own called City Lights. However, City Lights stated that Mr. Yakoviev was the previous owned and no longer owned the business or worked there. 10. To date, Mr. Yakoviev has not sent the vehicle title to Capitol. 11. Effective October 2, 2006, Capitol insured the vehicle through its insurance carrier. A copy of the Insurance Identification Card is attached as Exhibit "C." 12. On or about March 2, 2007, while operating the vehicle in Atlantic City, New Jersey, Capitol's driver was issued various citations by the New Jersey Department of 2 Transportation ("NJDOT"), which was performing a routine inspection of various passenger vehicles. 13. Because Capitol's driver did not have proof of ownership of the. vehicle, the vehicle was ultimately impounded. 14. On May 2, 2007, a hearing was held before a Municipal Court Judge in Atlantic County, New Jersey concerning the citations issued. Capitol paid approximately $4,000 in fines to the NJDOT. 15. ~ The NJDOT was satisfied that the vehicle was not a stolen vehicle. However, the NJDOT will not release the vehicle until Capitol presents a certificate of title of the vehicle to NJDOT. 16. Capitol is incurring and will continue to incur a fee of $50.00 per day for each day that the car remains on the impoundment lot. Thus, Capitol requests expedited consideration of this Petition. 17. On behalf of Capitol, the undersigned has performed amulti-state search concerning the title to this vehicle. See Affidavit of Kelly H. Decker, Esq. attached as Exhibit «D ~, 18. The California Department of Transportation has represented that the vehicle was never registered in California. However, the California DOT stated that someone, presumably Leo Yakoviev, started the title registration process in California, but it was never completed. The California DOT has confirmed that the vehicle was not stolen. See Exhibit "D." 19. The last known place of title was Norcross, Georgia. The title number issued by the State of Georgia is 776800042993905. A copy of the Carfax Report is attached as Exhibit "E;" see also Exhibit "D." 3 20. The Georgia Department of Revenue, the department which regulates vehicle titles in Georgia, confirmed that the title was last registered in Georgia. Georgia has advised that it cannot issue title to an out-of--state resident based upon a Bill of Sale. The Georgia Department of Revenue has also represented that the vehicle was not reported stolen. See Exhibit "D." 21. The Pennsylvania Department of Transportation ("PennDOT") will issue a Pennsylvania certificate of title to a vehicle if it is presented with the original title or a Court Order. See Exhibit "D." 22. In the absence of the original title, Capitol seeks a Court Order requiring PennDOT to issue title to the vehicle bearing VIN#1GYEK63N92R157447 in the name of Capitol Limousine Service, Inc. WHEREFORE, Capitol Limousine Service, Inc. requests that this Court enter an Order conforming to the language provided in the attached Proposed Court Order and award ownership of the 2002 Cadillac Escalade Limousine, VIN # 1 GYEK63N92R157447 to Capitol Limousine Service, Inc. extinguishing the right, title, and interest of any other person to said vehicle, and permitting the Pennsylvania Department of Transportation to accept this order as evidence of ownership in lieu of a certificate of title. I am an adult residing in the Commonwealth of Pennsylvania. 2. During the relevant time period, September 14-16, 2006, I was a driver employed by Capitol Limousine Service, Inc. 3. On or about September 14, 2006, I traveled to Sacramento, California to complete the transaction for the purchase of a 2002 Cadillac Escalade SUV bearing the vehicle identification number 1 GYEK63N92R157447 and to obtain title to and possession of the vehicle. 4. Upon arriving and inspecting the vehicle, Mr. Yakoviev represented that he did not yet have the title to the vehicle, but that the title was currently being processed by the California Department of Motor Vehicles. 5. On September 15, 2006, Mr. Brown, Mr. Yakoviev and Mr. Yakoviev's friend Russ went to a satellite Department of Motor Vehicles office in Rossville, California to inquire about the title to the vehicle. 649661.1 6.
