WHEREAS, MARK C. SPICHER and KOLENE E. SPICHER, of 517 Halyard Drive
Enola, Pennsylvania 17025 (hereinafter together called "Owner"), are about to execute
contemporaneously herewith, a contract with Mark C. Spicher, an independent contractor of
1452 Trindle Road, Carlisle, Pennsylvania 17013 (hereinafter called "Contractor"), for the
erection of a building on land situate and described as follows:
ALL THAT CERTAIN land or tract of ground located in Silver Spring Township,
Cumberland County, Pennsylvania bounded and described to wit:
BEGINNING at a point on the north eastern corner of the Lot for Pump Station; thence,
along the right of way of Louis Parkway S 87°44'47" E a distance of 139.50' to a point;
thence, along the same S 2° 15' 13" W a distance of 15.00' to a point; thence, along the
same S 87°44'47" E a distance of 25.00' to a point; thence, along Lot 6 S 2°15' 13" W a
distance of 385.00' to a point; thence, along the right of way of Carlisle Pike (SR 0011) N
87°44'47" W a distance of 215.00' to a point; thence, along Lot 4 N 02°15' 13" E a
distance of 342.66' to a point; thence, along the Lot for Pump Station S 87°44'47" E a
distance of 50.50' to a point; thence, along the same N 2° 15' 13" E a distance of 57.34' to
a point, the place of BEGINNING .
CONTAINING 82,729 sq. ft. (1.90 acres).
UNDER AND SUBJECT to any and all easements, restrictions and other matters of
record and which a physical inspection of the premises would disclose.
AND the said GRANTOR will SPECIALLY warrant and forever defend the property
hereby conveyed.

NOW, this ~~day of April, 2007, at the time of and immediately before execution
of the principal contract, and before any authority has been given by Owner to Contractor to

commence work on the said building, or to purchase materials for the same, in consideration of
the making of the said contract with Contractor and the further consideration of One and 00/100
($1.00) Dollar, to Contractor paid by Owner, it is agreed that no lien shall be filed against the
above described premises and the building and improvements to be erected thereon, by
Contractor, or any subcontractor, or by any of the materialmen or workmen, or any other person
for any labor provided or materials purchased, or for extra labor provided or materials purchased
for the erection of said building and improvements, the right to file such liens being expressly
waived.
