I. Plaintiff is Robert L. Arnold, an adult individual, sui juris, who currently resides at 23 Beacon
Drive, City of Harrisburg, County of Cumberland, Commonwealth of Pennsylvania 17112.
2. Defendant is Coreen M. Arnold, an adult individual, sui juris who currently resides at
267 North Middlesex Road, City of Carlisle, County of Cumberland, Commonwealth of Pennsylvania
17013.
3. Plaintiff has been a bona fide resident of the Commonwealth of Pennsylvania for a
period of more than six (6) months immediately preceding the filing of this complaint.
4. The parties were married on the 2nd day of June 1984, County of Cumberland,
Commonwealth of Pennsylvania.
5. Neither Plaintiff nor Defendant is in the military or naval service of the United States or
its allies within the provisions of the Soldiers' and Sailors' Civil Relief Act of the Congress of 1940 and its
amendments.
6. There have been no prior actions for divorce or annulment instituted by either of the
parties in this or any other jurisdiction.
7. For purposes of ~ 3301(d) of the Divorce Code, the parties have been living separate and
apart since on or about May 16, 2003.
8. The marriage is irretrievably broken.
9. Plaintiff has been advised that counseling is available and that Plaintiff may have the
right to request that the court require the parties to participate in counseling.
10. Plaintiff intends to file an affidavit of consent after 90 days have elapsed from the date of service
of the Complaint on the defendant and believes that defendant will also file such an affidavit.

II. The prior paragraphs of this Complaint are incorporated herein by reference thereto.
12. The marriage of the parties is irretrievably broken.
WHEREFORE, Plaintiff respectfully requests the Court to enter a decree of divorce pursuant to ~
3301(c) of the Divorce Code.

PETITION FOR EQUITABLE DIVISION, DISTRIBUTION AND ASSIGNMENT OF MARITAL
PROPERTY
13. The averments of paragraphs 1 through 12 of Count I are incorporated herein by
direct reference thereto as if set forth verbatim.
14. The parties are the owners of various items of persona 1 property and real property
which qualifY as marital property as defined in Section 401 of the 1980 Divorce Code.
15. Said marital property includes life insurance policies on the life of Defendant of
which the Plaintiff is the beneficiary.
16. Said marital property is subject to equitable division, distribution and assignment by
this Court.
WHEREFORE, Plaintiff prays that this Honorable Court:
(a) equitably divide, distribute and assign all the parties' marital property;
(b) require Defendant to maintain appropriate life insurance on his life naming
Plaintiff as the beneficiary; and
(c) enjoin Defendant from transferring or encumbering any marital property
during the pendency of this action.

PETITION TO PREVENT DISSIPATION OF
MARITAL ASSETS
Petitioner, Coreen M. Arnold, by and through her attorneys, Killian & Gephart,
hereby files this petition for injunctive relief, and in support thereof, avers the following:
1. Petitioner is Coreen M. Arnold, Defendant, (hereinafter referred to as
Wife) in the above-captioned divorce action.
2. Respondent is Robert L. Arnold, Plaintiff, (hereinafter referred to as
Husband) in the above-captioned divorce action.
3, On or about August 5, 2003, Husband filed a Complaint in Divorce
requesting that "the court equitably divide, distribute and assign all the parties' marital
property; require [Wife] to maintain appropriate life insurance on [her] life naming
[Husband] as beneficiary; and enjoining Wife from transferring or encumbering any
marital property during the pendency of the action."
4. Wife believes that Husband may sell, transfer, dissipate, damage, destroy,
encumber, remove, dispose, or otherwise alienate any or all of the marital assets or her
premarital assets, including, but not limited to, marital property, which has an estimated
value in excess of $50,000, presently located in a storage unit at The Storage Depot, 115

incorporated herein).
5, On or about April 24, 2003, Husband and Wife leased a storage unit at
the aforementioned facility for which Wife had assumed complete financial
responsibility. (See Exhibit B, attached hereto and incorporated herein.)
6. On August 19, 2003, Wife learned from the manager at The Storage Depot
that Husband had unilaterally terminated the above-referenced lease and had a third party
lease the unit on his behalf. As more fully set forth above, the storage unit at issue
contains the parties' marital property, as well as Wife's non-marital property.
7. Wife respectfully requests the Court's permission to conduct an on-site
inspection of the storage unit in order to determine if Husband has, without her
knowledge and/or consent, removed any of the items referenced on Exhibit A, Wife is
able to make this determination simply by viewing both ends of the storage unit because
said unit is filled to its maximum capacity on both ends of the building.
8. Section 3323(f) of the Divorce Code provides the following:
In all matrimonial causes, the Court shall have full equity
power and jurisdiction and may issue injunctions or other
orders which are necessary to protect the interests of the
parties or to effectuate the purposes of this part, and may
grant such other relief or remedy as equity and justice require
against either party or against any third person over whom the
Court has jurisdiction and who is involved in or concerned
with the disposition of the cause.
9. In addition, Section 3505(a) of Title 23 states that:
Where it appears to the Court that a party is about to leave the
jurisdiction of the Court or is about to dispose of, alienate, or
encumber property in order to defeat equitable distribution,
alimony pendente lite, alimony, child and spousal support or
similar award, an injunction may issue to prevent the removal
or disposition and the property may be attached as prescribed
by general rules. The Court may also issue a writ of ne exeat
to preclude the removal.
10, Moreover, "an encumbrance or disposition of marital property to third
persons who paid wholly inadequate consideration for the property may be deemed
fraudulent and declared void." 23 Pa.C,S.A. ~3505 (e).
11. At any time after the filing of the complaint, on petition setting forth the
facts entitling the party to relief, the Court may, upon such terms and conditions as it
deems just, including the filing of security,
(1) issue preliminary or special injunctions necessary to prevent the
removal, disposition, alienation or encumbering of real or personal
property in accordance with Rule l53l(a), (c), (d) and (e); or
(2) order the seizure or attachment of real or personal property; or
(3) grant other appropriate relief,
WHEREFORE, Petitioner Wife, respectfully requests that this Honorable Court
grant the foregoing petition for injunctive relief and enjoin and restrain Husband from
selling, transferring, encumbering, dissipating, selling, damaging, destroying, removing
or otherwise alienating any and all marital assets or premarital assets of Wife, particularly
the personal property presently located in a storage unit at The Storage Depot, 115
Cumberland Parkway, Mechanicsburg, P A 17055, pending further order of court in this
matter,
