COX, Defendants MORTGAGE FORECLOSURE COMPLAINT IN MORTGAGE FORECLOSURE 1. The Plaintiff, Eastern Bank having an office and place of business at 270 Union Street, Lynn, Massachusetts, 01901, brings this action to foreclose a mortgage, dated March 11, 1998, between Defendants, Scott D. Fatkin and Laurie M. Fatkin and Eastern Bank. 2. The Plaintiff is the holder of a Mortgage executed and delivered by the Defendants, Scott D. Fatkin and Laurie M. Fatkin, whose last known addresses are: Scott Fatkin 4830 S. Wilson Road, Elizabethtown, Kentucky and Laurie Fatkin 441 North College Street, Carlisle, Pennsylvania 17013, the mortgage was recorded in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Mortgage Book 1437, Pages 376-379, on property located at 2005 Pine Road, Newville, Cumberland County, Pennsylvania, 17241 ("the property"). A copy of said Mortgage and the description is attached hereto, made a part hereof, and marked as Exhibit "A'. 3. The Mortgage is in default in that the Defendants have failed to pay the contracted monthly payments when due, and such arrearage has continued for more than thirty (30) days. 4. The following amounts are due upon the Mortgage: a. Principal balance due as of 12/17/2002 $70,539.16 Accrued Interest due as of 12/17/2002 Per Diem 19.03 Current Interest Rate: 985% Amount due as of 12/17/2002 1,314.15 72,329.71 5. Attached hereto, made a part hereof and marked as Exhibit "B", are true and correct copies of the notices of Homeowners' Emergency Mortgage Assistance Act 91 which were mailed to the Defendants on or about March 18, 2003 and March 26, 2003. 6. Attached hereto, made a part hereof and marked as Exhibit "C", are true and correct copies of proof of service of mailing the Act 91 Notice to Defendants. 7. Defendants have not cured said default pursuant to said Notice of Intention to Foreclose and more than thirty (30) days have elapsed since receipt of said Notice by the Defendants. WHEREFORE, Plaintiff, Eastern Bank, demands judgment in favor of Plaintiff and against Defendants, Scott Fatkin and Laurie Fatkin, in the amount of Seventy-two Thousand Three-hundred Twenty-nine Dollars and Seventy-one Cents ($72,329.71) plus legal fees, accruing interest, late charges and escrow deficits. You may do so by paying the total amount then past due, plus any late or other charges then due, reasonable attorney's fees and costs connected with the foreclosure sale and any other costs connected with the Sheriff's Sale as specified in writing by the lender and by performing any other requirements under the mortgage.
