CIVIL ACTION MORTGAGE FORECLOSURE
1. LaSalle National Bank, As Trustee Under the Pooling and Servicing Agreement
dated 6/1/99, Series 1999-2, (hereinafter referred to as "Plaintiff') is an
Institution, conducting business under the Laws of the Commonwealth of
Pennsylvania and brings this action to foreclosure the mortgage between
Bruce G. Toole, Mortgagor(s) (hereinafter referred to as "Defendant") and itself
as Mortgagee by Assignment. Said Mortgage was dated February 9, 1999 and
was recorded in the Office of the Recorder of Deeds and Mortgages in Cumerland
County in Mortgage Book 1526, page 130. A copy of the Mortgage is attached
and made a part hereof as Exhibit `A'.
2. The Mortgage is secured by Defendant(s) Note dated February 9, 1999 in the
amount of $62,500.00 payable to Plaintiff in monthly installments with an interest
rate of 10.525%.
3. The land subject to the mortgage is:
116 4th Avenue, New Cumberland, PA 17070.
4. The defendant(s), Bruce G. Toole is/are the real owner(s) of the land subject to the
mortgage and the Defendants' address is :116 4th Avenue, New Cumberland, PA
17070.
5. The Mortgage is now in default due to the failure of the Defendant(s) to make
payments as they become due and owing. The following amounts are due:
Principal Balance $61,788.70
Interest to 11/6/2000 3,017.61
Accumulated Late Charges 198.30
Buydown (Financing of odd days 4,884.74
interest)
Appraisal 162.00
Attorney Fees/Costs 3,700.00
TOTAL $73,751.35
plus interest from 11/7/2000 at $14.37 per day, costs of suit and attorney fees.
6. In accordance with the provisions of the Act of January 30, 1974, P.L. 13 No.
6, Section 403 (41 P.S. 403), a Notice of Intention to Foreclose is required and
the Notice of Homeowners' Emergency Mortgage Assistance was sent to
defendants July 13, 2000. The Defendant(s) have not cured the default.
WHEREFORE, Plaintiff requests the court enter judgment in Mortgage Foreclosure for
the sale of the mortgaged property in Plaintiff's favor and against the Defendant(s), in the
sum of $73,751.35 together with the interest from 11/7/2000 at $14.37 per day, costs of
suit and attorney fees.

application to the Pennsylvania Housing Finance Agency. Your application MUST be filed or postmarked

that were actually incurred, up to $50.00. However, if legal proceedings are started against you, you will
have to pay all reasonable attorneys' fees actually incurred by the lender even if they exceed $50.00. Any
attorney's fees will be added to the amount to the lender, which may also include other reasonable costs. If
OTHER LENDER REMEDIES- The lender may also sue you personally for the unpaid principal balance
and all other sums due under the mortgage.
RIGHT TO CURE THE DEFAULT PRIOR TO SHERIFF'S SALE- [f you have not cured the default
within the THIRTY (30) DAY period and foreclosure proceedings have begun, you still have the right
suecified in writine by the lender and by performing anv other reauirements under the mortgage. Curing
