Smith, ~d files this Petition for Appeal from Order of Suspension as Entered by the Director of Bureau of Driver Licensing of the Commonwealth of Pennsylvania, the following of which is a more specific statement: 1. Petitioner is John I. Smith, who cu~ently resides at 17 UmbeKo Avenue, New Cumberland, Cumberland County, Pennsylvania 17070. 2. Petitioner is holder of Driver's License No. 21016170, as issued by the Commonwealth of Pennsylvania, Depa~ment of Transpo~ation (the "Department"). 3. Petitioner has received notice from the Department that his operating privileges will be suspended effective at 12:01 a.m on November 9, 2001, due to ~ alleged violation of Section 1547 of the Motor Vehicle Code. A copy of said notice is a~ached hereto as Exhibit 4. Petitioner maintains that said suspension is improper in that Petitioner did not violate Section 1547 of the Pennsylvania Vehicle Code as alleged by the Director of the Bureau of Licensing 5. Petitioner hereby appeals from the Order of Suspension as issued by the Director of the Bureau of Licensing WHEREAS, Petitioner respectfully requests that, under and pursuant to the provisions of the Pennsylvania Motor Vehicle Code, an appeal be allowed in this matter and that the same be set down for hearing upon thirty (30) days notice to the Pennsylvania Department of Transportation, at which time this Honorable Court shall receive testimony and examine into the facts of this case to determine whether or not Petitioner is subject to the suspension of his operator's privileges as heretofore decreed by the Director of the Bureau of Driver Licensing, and that said appeal should operate and act to supersede the decree of the Director of the Bureau of Licensing in this matter. .
