CIVIL ACTION/MORTGAGE FORECLOSURE
I. Plaintiff is Beneficial Consumer Discount Company d/b/a Beneficial Mortgage Company
of Pennsylvania, a corporation duly organized under the laws of Pennsylvania and doing business at the
above captioned address.
2. The Defendant is Barry Deitch a/k/a Barry L. Deitch, who is one of the mortgagors and real
owners of the mortgaged property hereinafter described, and his last-known address is 101 Main Street,
Walnut Bottom, P A 17266.
3. The Defendant is Gay Deitch a/k/a Gay L. Deitch, who is one of the mortgagors and
real owners of the mortgaged property hereinafter described, and her last-known address is 101 Main
Street, Walnut Bottom, P A 17266.
4. On 10/04/2000, the Defendant, United States of America, acquired a lien against the
premises hereinafter described in the sum of $33,477.33, subordinate to the mortgagee hereinafter
referred to, by reason of Federal Tax Lien, Number 2000-06788, in favor of the United States of
America against Barry L. and Gay L. Deitch, and which is recorded in the Office of the Prothonotary
of Cumberland County, Pennsylvania.
5. Notice of this lien was filed on 10/04/2000, at the Office of the Prothonotary of
Cumberland County, by the Internal Revenue Service, Philadelphia, Pennsylvania. A true and
correct copy of court docket is attached hereto and marked as Exhibit "A."
6. By the filing of this action, Plaintiff seeks a judicial sale ofthe premises hereinafter
described.
7. On 11/22/1996, mortgagor made, executed and delivered a mortgage upon the
premises hereinafter described to Plaintiff which mortgage is recorded in the Office of the Recorder
of Cumberland County in Mortgage Book 1353, Page 363.
8. The premises subject to said mortgage is described in the mortgage attached as
Exhibit "B" and is known as 87 Victory Church Road, Gardners, PA 17324.
9. The mortgage is in default because monthly payments of principal and interest upon
said mortgage due 08/20/2002 and each month thereafter are due and unpaid, and by the terms of
said mortgage, upon default in such payments for a period of one month, the entire principal balance
and all interest due thereon are collectible forthwith.
10. The following amounts are due on the mortgage:
Principal Balance $ 37,800.56
Interest ilirough 08/04/2003 $ 21,371.66
(Plus $ 15.oJ per diem thereafter)
Attorney's Fee $ 1,890.02
Cost of Suit $ 225.00
Appraisal Fee $ 125.00
Title Search $ 200.00
GRAND TOTAL $ 61,612.24
II. The attorney's fees set forth above are in conformity with the mortgage documents and
Pennsylvania Law and will be collected in the event of a third party purchaser at Sheriffs Sale. If the
mortgage is reinstated prior to the Sale, reasonable attorney's fees will be charged based on work actually
performed.
12. Notice ofIntention to Foreclose as required by Act 6 of 1974 (41 P.S. ~403) and notice
required by the Emergency Mortgage Assistance Act of 1983 as amended under 12 PA Code Chapter 13, et
seq., commonly known as ilie Combined Notice of Delinquency has been sent to Defendants by regular mail
with certificate of mailing.
WHEREFORE, Plaintiff demands Judgment against the Defendants in the sum of $61,612.24,
together with interest at the rate of $15.01 per diem and other costs and charges collectible under the
mortgage and for the foreclosure and sale of ilie mortgage property and that the lien of the United States of
America be discharged.

on December 13,2005 at 7:09 o'clock PM, he served a true copy of the within Real
Estate Writ, Notice of Sheriffs Sale and Description, in the above entitled action, upon
the within named defendant, to wit: Barry L. Deitch, by making known unto Barry L.
Deitch, personally, at 1135 Centerville Road, Newville, Cumberland County,
Pennsylvania, its contents and at the same time handing to him personally the said true
and correct copy of the same.
Robert Bitner, Deputy Sheriff, who being duly sworn according to law, states that
on December 13, 2005 at 8:10 o'clock PM, he served a true copy of the within Real
Estate Writ, Notice of Sheriffs Sale and Description, in the above entitled action, upon
the within named defendant, to wit: Gay L. Deitch, by making known unto Gay L.
Deitch, personally, at 101 East Main Street, Walnut Bottom, Cumberland County,
Pennsylvania, its contents and at the same time handing to her personally the said true
and correct copy of the same.
Valerie Weary, Deputy Sheriff, who being duly sworn according to law, states
that on January 23,2006 at 2:15 o'clock P.M., she posted a true copy of the within Real
Estate Writ, Notice, Poster and Description, in the above entitled action, upon the
property of Barry L. Deitch and Gay L. Deitch, located at 87 Victory Church Road,
Gardners, Pennsylvania, according to law.
R. Thomas Kline, Sheriff, who being duly sworn according to law, states he
served the above Real Estate Writ, Notice, Poster and Description in the following
manner: The Sheriff mailed a notice of the pendency of the action to the within named
defendant, to wit: Barry L. Deitch, by regular mail to his last known address of 1135
Centerville Road, Newville, P A 17241. This letter was mailed under the date of January
05,2006 and never returned to the Sheriffs Office.
