Restoration, Inc. ("Contractor") in favor of David G. Strand and Ceceile~trand ("Owners).
Whereas, Owners are about to execute contemporaneously herewith, a contract with
Contractor for improvements to a single family dwelling upon land situate in the Borough of
Carlisle, Cumberland County, Pennsylvania, more fully described as follows:
ALL THAT CERTAIN lot of ground situate in the Third Ward of the Borough of
Carlisle, Cumberland County, Pennsylvania, bounded and described as follows:
BEGINNING at a point on the western line of Wilson Street at the intersection of the
line dividing the lot herein described and land now or formerly of George B. Faller
and wife; thence by said latter line, South 87 degrees 55 minutes West 153 feet, more
or less, to a point; thence northwardly parallel with said Wilson Street, 117 feet to a
point at line of land now or formerly of John W. McTaggart; thence eastwardly along
said latter land at right angles to said last mentioned line, 150 feet, more or less, to
a point on the Western line of said Wilson Street; thence by said Wilson Street, South
13 degrees West 96 feet to a point, the Place of BEGINNING.
BEING Lot No. 1 on a certain Plan of Sun Dial Terrace as the same is recorded in the
Office of the Recorder of Deeds in and for Cumberland County in Plan Book 5, Page
44.
SUBJECT to restrictions as set forth in Deed of Paul E, Dutrey and Elizabeth K.
Dutrey dated May 17, 1957, and recorded in the Office aforesaid in Deed Book "U",
Volume 17, Page 378, to Richard W. Dutrey and Marjorie B. Dutrey.
The above described property being improved with a one-story dwelling house
known and numbered as 348 Wilson Street, Carlisle, Pennsylvania.
Now,~0~ 30 ,2003, at the time of and immediately before the execution of the
construction co'htract Bforesaid, and before any authority has been given by the said David G. Strand
and Ceceile Strand to the said Tuckey's Restoration, Inc. to commence work on the said building,
or purchase materials for the same, in consideration of the Owners making of the said contract with
Contractor, and intending to be legally bound hereby, it is agreed that no lien shall be filed against
the building by Contractor, or any sub-contractor, nor by any of the materialmen or workmen or any
other person for any labor, or materials purchased, or extra labor or materials purchased for the
erection of said building, the right to file such liens being expressly waived.
