Lehman & Michelle A..Lehman Daihl Construction Newburg, PA : 03- :232 Old Sawmill Road :Newburg, PA 17240 STIPULATION AGAINST LIENS WHEREAS, Gregory W. Lehman and Michelle A. Lehman, the OVqNERS of the real estate described below, has or is about to execute contract with Daihl Construction of Newburg, PA, whose principal place of business is located at 130 Pinnacle Drive, Newburg, PA 17240, to install as indicated on Order No. 2003060282 at the project site known and numbered as 232 Old Sawmill Road, in Hopewell Township, Cumberland County, Pennsylvania, as more particularly bounded and described on Exhibit "A", attached hereto and made a part hereof; and NOW, THEREFORE, this day of July, 2003, before any authority had been given by Gregory W. Lehman and Michelle A. Lehman to Daihl Construction to commence work on said site, or purchase materials for same, in consideration of making of the above described Contract with Gregory W. Lehman and Michelle A. Lehman, and in further consideration of ($145,000.00) paid to the Contractor by Gregory W. Lehman and Michelle A. Lehman, the receipt whereof is hereby acknowledged, it is agreed that no mechanics liens or claims shall be filed or maintained against the Owners facilities and the land above described, or upon Gregory W. Lehman and Michelle A. Lehman, the Owners, by the Contractor or by any of the materialmen or workmen, or any other person acting through or under them, for or on account of any labor, or materials purchased, or extra labor or materials purchased for, towards, in or about the erection, construction, design and improvement of said facilities, under said contract or otherwise, the right to have, file and maintain such liens or claims against the facility, the land above described, and Gregory W. Lehman and Michelle A. Lehman, the Owners being hereby expressly waived by the Contractor for itself, its Contractors, all materialmen, or workmen and others acting through or under them. 1N WITNESS WHEREOF, each of the parties by their duly authorized representatives have hereunto executed this Stipulation Against Liens this day of June, 2003.
