THIS AGREEMENT, made the 30¢/- day of July, 2003, by and between
THE McNAUGHTON COMPANY

hereinafter referred to as Contractor,
AND
ERIC FASSER and DEBORAH M. FASSER
115 May Drive, Camp Hill, PA 17011
hereinafter referred to as Owner,
Whereby the former undertook and agreed to erect and construct a single family dwelling on that certain
lot of ground situate in Hampden Township, Cumberland County, Pennsylvania more fully described in
Deed Book 34-L, page 954
Being further identified as Tax Parcel No. 10-13~0991-043
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and in
consideration of the sum of ONE DOLLAR ($1.00) to him in hand paid by Owner, the receipt whereof is
hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for
themselves and their subcontractors, and all parties acting through or under them, covenant and agree
that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection
and construction of the said buildings on the lot above-described, and the said Contractor, for
themselves, their subcontractors and others under them, hereby expressly waive and relinquish the right
to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and
agree that this instrument, waiving the right of lien, shall be an independent covenant.

County, Pennsylvania, and bounded and described as follows:
BEGINNING at a point on the Northern right-of-way line of the cul-de-sac on Sprin!;
Tree Court (50.00 feet wide), said point being located at the Northeastern comer of Lot No..~6;
then along the Northern boundary line of Lot No. 46, North 41 degrees 03 minutes 45 secor~ds

feet, to a point on the Northern right-of-way of Spring Tree Court (50.00 feet wide); then along
said right-of~way line on the arc ofa cimle curving to the right, having a radius of 25.00 feet, and
an arc length of 18.14 feet, to a point; then along same on the arc of a circle curving to the left,
having a radius of 50.00 feet, and an arc length of 71,63 feet to a point, and the place of
BEGINNING.
This piece, parcel or lot of land consists of approximately 13,131.76 square feet of rand,
ar.d is known and numbered as Lot No. 47 on the Final Subdivision Plan for Westhury - Phase
II [, which is recorded in Cumberland County in Plan Book 71, Page 119.
BEING the same premises which The McNaughton Company, a Pennsylvania
Corporation, by its Deed dated July 30, 2003 and to be recorded herewith,
granted and conveyed unto Eric Fasser and Deborah Fasser, husband and wife.
