For dates of death on or after July 1, 1994 and before January 1, 1995, the tax rate imposed on the net value of transfers to or for the use of the
surviving spouse is 3% [72 P.S. 9116 (a) (1.1) (i)].
For dates of death on or after January 1, 1995, the tax rate imposed on the net value of transfers to or for the use of the surviving spouse is 0%
[72 P.S. 9116 (a) (1.1) (ii)]. The statute does not exempt a transfer to a surviving spouse from tax, and the statutory requirements for disclosure of assets
and tiling a tax return are still applicable even if the surviving spouse is the only beneficiary.
For dates of death on or after July 1, 2000:
The tax rate imposed on the net value of transfers from a deceased child twenty-one years of age or younger at death to or for the use of a natural
parent, an adoptive parent, or a stepparent of the child is 0% [72 P.S. 9116 (a) (1.2)]. -
The tax rate imposed on the net value of transfers to or for the use of the decedent's lineal beneficiaries is 4.5%, except as noted in 72 P.S. 9116( 1.2)

The tax rate imposed on the net value of transfers to or for the use of the decedent's siblings is 12% [72 P.S. 9116(a)(1.3)]. A sibling is defined, under

I, MARY C. KRATER, of New Cumberland, Cumberland County, Pennsylvania
being of sound mind, memory and understanding, do hereby make, publish and
declare this as and for my Last Will and Testament hereby revoking and making void
any and all other wills by me at any time heretofore made.
I.
I direct that my Executor hereinafter named shall pay all my just debts and
funeral expenses as soon as conveniently may be done after my decease.
II.
All the rest, residue and remainder of my estate, whether real, personal or
mixed, and wheresoever situate, I hereby give, devise and bequeath to my niece,
ROSEMARY DILLER CLAAR, or if she is not living, then unto her issue, in equal
shares, per stirpes.

Dear Attorney McCaleb:
This letter is in response to the recent telephone conversation concerning the monies Mrs.
Krater had invested with the Conference Committee on Loans, which is a benevolent
lending fund. The fund does have the option to change interest being paid with a six.
months notice. During that six month period, the individual has the right to withdraw any
money without penalty or loss of interest. The last date that change took place was May
1, 2003, when the, rate on all investments was changed to 5 1/2%. At that time Mrs.
Krater did not choose to withdraw her money from the fund..
The investment certificates for Mrs. Krater have all been placed in one account, Account
Number 2-11551, totaling Fifty Thousand Dollars ($50,000.00). Asindicated in my
previous communication the interest that had accrued from May 1,2006 to September 9,
2006 was $994.52. Interest on this investment account was last paid on May 1, 2006.
The certiticates have been transferred to the Estate of Mary C. I<rater.

STATEMENT
On 11/04/99, Decedent purchased from Nationwide Life
Insurance Company a $10,000.00 single payment annuity policy
(Contract No. 01-5341813). Under the terms of that policy,
Decedent was entitled to receive monthly annuity payments for
life from the Annuitization Date (the first day of the month
following her 90th birthday on 12/11/03), with 10 years
certain. She designated her niece, Rosemary Claar, as her
beneficiary in the event of her death before the guaranteed
period expired. Although entitled to monthly benefits as of
01/01/04, Decedent never collected any benefits under the
policy before her death on 09/09/06 and the entire Contract
Value of the policy ($13,539.93) was paid to her beneficiary
pursuant to the terms of the policy. Because Decedent had the
right to monthly payments during her lifetime and chose not to
receive them, she obviously intended that all the annuity
benefits would be payable to her beneficiary upon her death,
like life insurance, and so such benefits should be exempt from
