1. Plaintiff, Alvin Whittle, hereinafter referred to as "Father", resides at 145 Sugar Maple
Drive, Etters, Pennsylvania, and is the natural father of the minor child, Layla Whittle, born November
24, 2003.
2. Defendant, Susan Cronin, hereinafter referred to as "Mother", resides c/o Litha Cronin, G
4 Federal Drive, Mount Union, Pennsylvania, and is the natural mother of Layla Whittle.
3. Plaintiff seeks primary physical custody of the minor child.
The child was born out of wedlock.
The child is presently in the custody of the Natural Father, who resides at the
respective residence set forth above.

pending in a Court of this Commonwealth or in any other state.
8. Plaintiff does not know of a person not party to these proceedings who has physical
custody of the child or claims to have custody or visitation rights with respect to the child.
9. The best interests and permanent welfare of the child will be served by granting the relief
requested for the following reasons:
a. On April 10, 2006, Huntingdon County Children and Youth Services filed a
Petition for Emergency Protective Custody while the child was in the care of the natural mother;
father;
b. Following investigation by the Agency, the child was returned to the care of the
c. Father believes it is necessary and in the child's best interests to confirm the
present custodial arrangement. In addition, based on the closing letter from Huntingdon County
Children and Youth Services, it is believed that a custody order is necessary to provide mother
with meaningful periods of visitation given the concerns raised by the agency. /
WHEREFORE, Plaintiff respectfully requests this Honorable Court to grant him physical and
legal custody of the minor child, Layla Whittle.

educational seminar on the impact on children of separation and divorce given monthly
in the Classroom Building at the J.C. Blair Memorial Hospital, Huntingdon,

PETITION TO MODIFY CUSTODY
1. The Petitioner, Susan E. Cronin, is the Defendant in the subject action. At the
present time, the Petitioner resides at 110 Church Street, Newton Hamilton, Pennsylvania
17075.
2. The Respondent, Alvin O. Whittle, is the Plaintiff in the subject action. At this
time, the Respondent resides at 421 Meadow Drive, Camp Hill, Pennsylvania 17011.
3. The parties are the parents of a minor child, Layla R. Whittle, born November
24, 2003.
4. By Order dated June 19, 2006, this Court awarded legal and physical custody
of the minor child to the Respondent, subject, nonetheless, "to the right of the mother to have
partial custody of the child at a schedule to be determined with the assistance of Huntingdon
County Children's Services." A copy of the aforesaid Order is attached hereto as Exhibit "A"
and made a part hereof.
5. At the time of entry of the aforesaid Order, the Petitioner was homeless. Now,
the Petitioner resides with her mother, Litha Cronin, at 110 Church Street, Newton Hamilton,
Pennsylvania.
6. Since the entry of the Court's June 19, 2006 Order, the Petitioner has only
been able to visit her daughter on three (3) occasions. By and large, visitations have not
occurred because they were cancelled by the Respondent. On one (1) occasion, the Petitioner

was able to see her daughter from Friday, October 13, at 6:00 p.m. until Sunday, October 15,
at 1:00 p.m.
7. At the present time, the Petitioner is able to nurture and caze for her daughter.
8. Sole custody isolates the child from the non-custodial pazent.
9. The best interests of the child require that open and meaningful access be
maintained with each parent and she have a relationship with each pazent.
10. The child has developed emotional attachment to each pazent and the severing
of either attachment is not in the child's best interests. In point of fact, the Petitioner cared for
the minor child from her date of birth until April 10, 2006.
11. Permitting each pazent to remain involved in the life of the child enables the
child to shaze with each pazent the intimate contact necessary to strengthen a true parent-child
relationship.
WHEREFORE, the Petitioner, Susan E. Cronin, respectfully requests that this Court
enter a Rule upon the Respondent, Alvin O. Whittle, directing him to show cause why shared
custody of the minor child should not be ordered.

PETITION FOR TRANSFER OF VENUE UNDER PA.R.C:P "191 d)

Plaintiff, Alvin Whittle, files this petition pursuant to Pa.R.C.P. 1915.2(d) to transfer this custody
action to the Court of Common Pleas of Cumberland County for the convenience of the parties and the
witnesses, for the following reasons:
1. This custody action was filed to the above referenced docket number in Huntingdon
County by the Plaintiff in 2006. At the time of the filing, the Plaintiff and the parties' minor child
resided in York County. However, since April of 2006, the Plaintiff and the minor child have resided in
Cumberland County.
2. Susan Cronin, the Defendant, for an extended period of time, resided in Cumberland
County and it is believed she is currently residing in Mifflin County.
3. Neither the primary custodian (Plaintiff j nor the minor child currently reside in
Huntingdon County.
4. The Plaintiff and the child have a significant connection with Cumberland County and
there is available within that county substantial evidence concerning the child's present and future care,
protection, training and personal relationships.
5. The child's caregivers and physicians reside in Cumberland County.
6. Rule 1915.2(d) provides that "For the convenience of the parties and witnesses, the court
upon petition of any party may transfer an action to the appropriate court of any other county where the
action could originally have been brought or could be brought at the time of filing the petition to transfer.

WHEREFORE, Plaintiff requests this Court to transfer this action to the Court of Common Pleas
of Cumberland County.
