Whereas, Rick J. and Jeanne E. Gilbert, his wife, of Cumberland
County, Pennsylvania is about to execute contemporaneously
herewith, a contract, with C & C Construction Inc., of 5745 Spring
Road, Shermansdale, Pennsylvania 17090 for the erection of a home
upon the land situate in Carlisle, Cumberland County, Pennsylvania
bounded and described as follows, to wit:
Lot 103 Pine Creek Road, Carlisle, PA
ALL THAT CERTAIN tract of land situate in North Middleton
Township, Cumberland County, Pennsylvania, designated as Lot No.
103 R on the Final Re-Subdivision Plan for The Village of Cross
Creek Portions of Phases E & G dated June 9, 2006 and recorded
October 20, 2006 in the Office of the Recorder of Deeds in and
for Cumberland County in Plan Book 93, Page 47, more particularly
bounded and described as follows;
BEGINNING at a point on the northern right of way line of Pine
Creek Drive, said point being the southwestern corner of Lot
104R; thence, along the northern right of way line of Pine Creek
Drive, North 86 degrees 35 minutes 43 seconds West a distance of
28.22 feet to a point; thence by same by a curve to the right
having a radius of 225.00 feet, an arc length of 80.51 feet and a
chord bearing of North 76 degrees 20 minutes 38 seconds West a
distance of 80.09 feet to a point; thence along Tract to be
removed from The Village of Cross Creek conditional use, North 13
degrees 19 minutes 03 seconds East, a distance of 127.65 feet to
a proposed concrete monument; thence South 86 degrees 35 minutes
43 seconds East a distance of 85.05 feet to a point; thence along
Lot 104R South 03 degrees 24 minutes 17 seconds West a distance
of 140.00 feet to a point, the place of BEGINNING.
CONTAINING 13,232 square feet.
BEING THE same premises which Penta Star Investments, Inc., by
its deed dated November 14, 2006, and recorded in the Cumberland
County Recorder of Deeds office in Book 277, Page 3275, granted
and conveyed to Rick J. Gilbert and Jeanne E. Gilbert owners.

NOW, 2007, at the time of and immediately
before the execution of the principal contract, and before any
authority has been given by the said OWNER to the said CONTRACTOR
to commence work on the said building, or purchase materials for
the same in consideration of the making of the said contract with
OWNER and the further consideration of One Dollar, to CONTRACTOR
paid by OWNER it is agreed that no lien shall be filed against the
building by the contractor, or any sub-contractor, nor by any of
the material men or workmen or any other person for any labor, or
materials purchased, or extra labor or materials purchased for the
erection of said building, the right to file such liens being
expressly waived.
