Rodrigo, Owners Michael Manning and Associates, Contractor IN THE COURT OF COMMON PLEAS CUMBERLAND COUNTY, PENNSYLVANIA NO. o3. STIPULATION AGAINST LIENS WHEREAS, Timothy P. Rodrigo, a single person, Thomas P. Rodrigo and Susan E. Rodrigo, husband and wife, of Pennsylvania, is about to execute contemporaneously herewith, a contract with Michael Manning and Associates of Cumberland County, Pennsylvania, for the erection of a dwelling upon a lot of land situate as follows: ALL THAT CERTAIN piece or parcel of land situate in the Township of East Pennsboro, Cumberland County, Commonwealth of Pennsylvania, being more fully described as follows: BEGINNING at a point on the dedicated fight-of-way line of Sullivan Street at the dividing line of Lot No. 17 and Lot No. 18, Hickory Ridge, Phase I, recorded in Plan Book 77, Page 143; thence by said dividing line South 31 degrees 09 minutes 08 seconds East, a distance of 436.26 feet to a point at the dividing line of Hickory Ridge, Phase II and lands herein described; thence by said dividing line the following two courses and distances: 1) South 78 degrees 40 minutes 51 seconds West, a distance of 78.22 feet to a point; 2) North 74 degrees 31 minutes 30 seconds West, a distance of 174.67 feet to a point at the dividing line of Lot No. 19 and Lot No. 18, herein described; thence by said dividing line North 08 degrees 14 minutes 02 seconds West, a distance of 321.98 feet to a point on the dedicated right-of-way line of Sullivan Street; thence by said right-of- way line by a curve to the left having a radius of 175.00 feet and an arc distance of 70.00 feet to a point, the place of BEGINNING BEING Lot No. 18 as shown on Final Subdivision Plan of Hickory Ridge, Phase I, recorded in Plan Book 77, Page 143 and being subject to all easements of record. CONTAINING 1.28 acres. UNDER AND SUBJECT to Federal, State and Local (if any), laws, rules, regulations applicable to Wetlands for the portion of the lot conveyed herein which is delineated as wetlands on Plan of Hickory Ridge, Phase I recorded in the Recorder of Deeds Office in and for York County in Plan Book 77, Page 143. GRANTEES, by acceptance of this deed, acknowledge that any activity or encroachment upon wetlands without appropriate federal and state permits is strictly prohibited by Federal Statute and Laws of the Commonwealth of Pennsylvania. GRANTEES, by acceptance of this deed, agree not to conduct any activity which will change, expand, or diminish the wetlands located on said lot as prohibited by law. NOW, the ~'~(3~'~ day of July, 2003, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Timothy P. Rodrigo, Thomas P. Rodrigo and Susan E. Rodrigo, to the said Michael Manning and Associates to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Michael Manning and Associates and the further consideration of One Dollar, to Michael Manning and Associates paid by Timothy P. Rodrigo, Thomas P. Rodrigo and Susan E. Rodrigo, it is agreed that no lien shall be filed against the building by the contractor, or any sub-contractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived.
