U ~ - ~I ~3 ~'1-) x.17 STIPULATION AGAINST LIENS WHEREAS, Lyle Forer and Ruth Forer, husband and wife, of Pennsylvania, is about to execute contemporaneously herewith, a contract with Starliper Fetsko Custom Homes, LLC of Cumberland County, Pennsylvania, for the erection of a dwelling upon a lot of land situate as follows: ALL THAT CERTAIN piece or parcel of land situate in the Township of Hampden, County of Cumberland and Commonwealth of Pennsylvania, more particularly bounded and described as follows, to wit: BEGINNING at a point on the western right-of--way line of Grandon Way at the common front property corner of Lot No. 1 and Lot No. 2 as shown on the hereinafter mentioned Plan of Lots; thence along said right-of--way line of Grandon Way by a curve to the right having a radius of 738.83 feet and an arc length of 154.56 feet to a point; thence continuing South 21 degrees 17 minutes 40 seconds East, a distance of 79.17 feet to a point at the dividing line between Lot No. 2 and Lot No. 3; thence along said dividing line South 56 degrees 50 minutes 14 seconds West, a distance of 200.82 feet to a point; thence North 33 degrees 06 minutes 15 seconds West, a distance of 230.95 feet to a point at the dividing line between Lot No. 1 and Lot No. 2; thence along said dividing line North 56 degrees 50 minutes 14 seconds East, a distance of 232.66 feet to a point, said point being the Place of BEGINNING. BEING Lot No. 2 on Preliminary/Fina1Subdfvision Plan for Lyle B. Forer and Ruth E. Forer, said plan recorded on March 26, 2007 in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania in Plan Book 93, Page 147. CONTAINING 51,109.00 square feet or 1.173 acres, more or less. of Lots. UNDER AND SUBJECT to all conditions as shown on the above mentioned Plan • ~ . BEING PART OF THE SAME premises which Robert D. Leisenring and Donna R. Leisenring, his wife, Scot Leisenring, Keith Leisenring and Brian Leisenring, Partners, by their deed dated March 30, 2006 and recorded April 13, 2006 in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania in Deed Book 274, Page 11, granted and conveyed unto Lyle Forer and Ruth Forer. NOW, the ~ day of May, 2007, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Lyle Forer and Ruth Forer, husband and wife to the said Starliper Fetsko Custom Homes, LLC to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Starliper Fetsko Custom Homes, LLC and the further consideration of One Dollar, to Starliper Fetsko Custom Homes, LLC paid by Lyle Forer and Ruth Forer, husband and wife it is agreed that no lien shall be filed against the building by the contractor, or any sub-contractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived.
