WHEREAS, W. MARK and CHRISTINE J. MARK, of 12 Drexel Place, New
Cumberland, Pennsylvania 17070 (hereinafter together called "Owner"), are about to execute
contemporaneously herewith, a contract with LION ENTERPRISES, INC., a Pennsylvania
corporation, t/d/b/a Bastian Homes., of 1301 Colonial Club Drive, Harrisburg, Pennsylvania
17112 (hereinafter called "Contractor"), for the erection of a dwelling house upon a lot of land
situate and described as follows:
ALL THAT CERTAIN piece or parcel of land situate in the Township of Hampden,
County of Cumberland and Commonwealth of Pennsylvania, more particularly bounded and
described as follows, to wit:
BEGINNING at a point on the southeastern right-of--way line of Creek View Road (a 60
foot right-of--way), said point being at the Southeast corner of the intersection of Creek View
Road and Grandon Way (a 60 foot right-of--way, 34 foot cartway); thence by the Southeastern
right-of--way line of Creek View Road, North 53 degrees OS minutes 58 seconds East, a distance
of 225.27 feet to a point at land now or formerly of Normandy Manor and South Central Service
Corporation,. 25-Q-1064; thence by land now or formerly of Normandy Manor and South Central
Service Corporation, the following courses and distances: (1) South 24 degrees 25 minutes 02
seconds East, a distance of 227.19 feet to a point; and (2) South 14 degrees 21 minutes 38
seconds East, a distance of 314.99 feet to a point at Lot C on the hereinafter mentioned Plan of
Lots; thence by Lot C, South 55 degrees 38 seconds 21 minutes West, a distance of 132.55 feet to
a point at the eastern right-of--way line of Grandon Way; thence by the Eastern right-of--way line
of Grandon Way, the following courses and distances: (1) North 20 degrees 46 minutes 22
seconds West, a distance of 212.96 feet to a point; (2) by a curve extending to the left in a
northwesterly direction, having a radius of 788.83 feet and arc length of 205.38 feet to a point;
(3) North 35 degrees 41 minutes 24 seconds West, a distance of 64.91 feet to a point; and (4) by
a curve extending to the right in a northeasterly direction, around the intersection of Grandon
Way and Creek View Road, having a radius of 35.00 feet, an arc length of 54.24 feet to a point
on the Southeastern right-of--way line of Creek View Road, the point and place of BEGINNING.
BEING Lot A on a Subdivision Plan of Grandon Farms Phase I recorded in Cumberland
County Plan Book 76, Page 61, and containing 93,726 square feet, or 2.15 acres.
BEING the same premises which Robert D. Leisenring and Donna R. Leisenring, his
wife, Scot Leisenring, Keith Leisenring, and Brian Leisenring, Partners, by their deed dated June
8, 2006 and recorded June 21, 2006 in the Office of the Recorder of Deeds in and for
Cumberland County, Pennsylvania, in Deed Book 275, Page 1150, granted and conveyed unto
Sean W. Mark and Christine J. Mark, husband and wife.
NOW, this 24th day of May, 2007, at the time of and immediately before execution of the
principal contract, and before any authority has been given by Owner to Contractor to commence
work on the said building, or to purchase materials for the same, in consideration of the making
of the said contract with Contractor and the further consideration of One and 00/100 ($1.00)
Dollar, to Contractor paid by Owner, it is agreed that no lien shall be filed against the above
described premises and the building and improvements to be erected thereon, by Contractor, or
any subcontractor, or by any of the materialmen or workmen, or any other person for any labor
provided or materials purchased, or for extra labor provided or materials purchased for the
erection of said building and improvements, the right to file such liens being expressly waived.
